Environmental Management and Pollution Control (Amendment of Schedule 2) Order 2019

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 11 of the Environmental Management and Pollution Control Act 1994 .

1.   Short title

This order may be cited as the Environmental Management and Pollution Control (Amendment of Schedule 2) Order 2019 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Principal Act

In this order, the Environmental Management and Pollution Control Act 1994 is referred to as the Principal Act.

4.    Schedule 2 amended (Level 2 Activities)

Clause 7 of Schedule 2 to the Principal Act is amended by omitting paragraph (d) and substituting the following paragraph:
(d) Pre-mix Bitumen Plants: works –
(i) in which crushed or ground rock aggregates are mixed, with bituminous or asphaltic materials, and heated, for the purpose of producing heated road-building mixtures; and
(ii) capable of producing more than 1 000 tonnes of material per year.

EXPLANATORY NOTE

(This note is not part of the order)

This order amends Schedule 2 to the Environmental Management and Pollution Control Act 1994 so as to exclude, from the class of activities that are classified as level 2 activities under the Act, pre-mix bitumen works conducted in or from mobile plant used in road building operations.
