Environmental Management and Pollution Control Order 2019
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 11 of the Environmental Management and Pollution Control Act 1994 .

This order may be cited as the Environmental Management and Pollution Control Order 2019 .
This order takes effect on the day on which its making is notified in the Gazette.
In this order, the Environmental Management and Pollution Control Act 1994 is referred to as the Principal Act.
4. Schedule 2 amended (Level 2 Activities)
Schedule 2 to the Principal Act is amended by omitting item 5 and substituting the following item:5. Extractive Activities(a) Quarries: the extraction of 5,000 cubic metres or more of rock or gravel per year if the extraction (i) is the subject of, or requires, a mining lease under the Mineral Resources Development Act 1995; or(ii) is carried out at a quarry in a State forest, within the meaning of the Mineral Resources Development Act 1995.(b) Extractive pits: the extraction of 5,000 cubic metres or more of sand or clay per year if the extraction is the subject of, or requires, a mining lease under the Mineral Resources Development Act 1995.(c) Mines: the extraction of any minerals producing 1 000 tonnes or more of minerals per year.

This order amends Schedule 2 to the Environmental Management and Pollution Control Act 1994 by substituting a new definition for extractive activities in the list of level 2 activities.
