Work Health and Safety Amendment Regulations 2019

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Work Health and Safety Act 2012 .

1.   Short title

These regulations may be cited as the Work Health and Safety Amendment Regulations 2019 .

2.   Commencement

These regulations take effect on 1 January 2021.

3.   Principal Regulations

In these regulations, the Work Health and Safety Regulations 2012 are referred to as the Principal Regulations.

4.    Regulation 394 amended (Meaning of lead risk work)

Regulation 394 of the Principal Regulations is amended as follows:

(a) by omitting from paragraph (a) "10[mu ]g/dL (0.48[mu ]mol/L)" and substituting "5[mu ]g/dL (0.24[mu ]mol/L)";

(b) by omitting from paragraph (b) "30[mu ]g/dL (1.45[mu ]mol/L)" and substituting "20[mu ]g/dL (0.97[mu ]mol/L)".

5.    Regulation 407 amended (Frequency of biological monitoring)

Regulation 407(1) of the Principal Regulations is amended as follows:

(a) by omitting from paragraph (a)(i) "30[mu ]g/dL (1.45[mu ]mol/L)" and substituting "10[mu ]g/dL (0.48[mu ]mol/L)";

(b) by omitting from paragraph (a)(ii) "30[mu ]g/dL (1.45[mu ]mol/L)" and substituting "10[mu ]g/dL (0.48[mu ]mol/L)";

(c) by omitting from paragraph (a)(ii) "40[mu ]g/dL (1.93[mu ]mol/L)" and substituting "20[mu ]g/dL (0.97[mu ]mol/L)";

(d) by omitting from paragraph (a)(iii) "40[mu ]g/dL (1.93[mu ]mol/L)" and substituting "20[mu ]g/dL (0.97[mu ]mol/L)";

(e) by omitting from paragraph (b)(i) "10[mu ]g/dL (0.48[mu ]mol/L)" and substituting "5[mu ]g/dL (0.24[mu ]mol/L)";

(f) by omitting from paragraph (b)(ii) "10[mu ]g/dL (0.48[mu ]mol/L) or more" and substituting "5[mu ]g/dL (0.24[mu ]mol/L) or more but less than 10[mu ]g/dL (0.48[mu ]mol/L)".

6.    Regulation 415 amended (Removal of worker from lead risk work)

Regulation 415(1)(a) of the Principal Regulations is amended as follows:

(a) by omitting from subparagraph (i) "50[mu ]g/dL (2.42[mu ]mol/L)" and substituting "30[mu ]g/dL (1.45[mu ]mol/L)";

(b) by omitting from subparagraph (ii) "20[mu ]g/dL (0.97[mu ]mol/L)" and substituting "10[mu ]g/dL (0.48[mu ]mol/L)";

(c) by omitting subparagraph (iii) .

7.    Regulation 417 amended (Return to lead risk work after removal)

Regulation 417(3)(a) of the Principal Regulations is amended as follows:

(a) by omitting from subparagraph (i) "40[mu ]g/dL (1.93[mu ]mol/L)" and substituting "20[mu ]g/dL (0.97[mu ]mol/L)";

(b) by omitting from subparagraph (ii) "10[mu ]g/dL (0.48[mu ]mol/L)" and substituting "5[mu ]g/dL (0.24[mu ]mol/L)".

These regulations amend the Work Health and Safety Regulations 2012 by implementing nationally agreed changes to blood lead levels in relation to the biological monitoring of workers.
