Work Health and Safety Amendment Regulations 2018
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Work Health and Safety Act 2012 .

These regulations may be cited as the Work Health and Safety Amendment Regulations 2018 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Work Health and Safety Regulations 2012 are referred to as the Principal Regulations.
4. Regulation 5 amended (Interpretation)
Regulation 5(1) of the Principal Regulations is amended as follows:(a) by omitting "a knuckle boom" from the definition of concrete placing boom and substituting "an articulating boom";(b) by omitting "chairlift, escalator, moving walkway" from paragraph (a) of the definition of lift and substituting "chairlift";(c) by omitting "liquid" twice occurring from paragraph (a) of the definition of pressure piping and substituting "fluid";(d) by inserting the following definition after the definition of specified VET course :steam turbine means equipment that is driven by steam acting on a turbine or rotor to cause a rotary motion;(e) by omitting the definition of tower crane and substituting the following definition:tower crane means –but does not include a self-erecting tower crane;(a) a crane that has a boom or a jib mounted on a tower structure; and(b) in Schedule 3 –(i) the crane, if a jib crane, may be a horizontal or luffing jib type; and(ii) the tower structure may be demountable or permanent –(f) by omitting the definition of turbine .
5. Regulation 21 amended (Training for health and safety representatives)
Regulation 21(1) of the Principal Regulations is amended as follows:(a) by inserting in paragraph (a) "up to" after "training of";(b) by omitting from paragraph (b) "1" first occurring and substituting "up to 1".
6. Regulation 96 amended (Notice of change of address)
Regulation 96 of the Principal Regulations is amended by omitting "give written notice to" and substituting "notify".
7. Regulation 98 amended (Replacement licence document)
Regulation 98(1) of the Principal Regulations is amended by omitting "give written notice to" and substituting "notify".
8. Regulation 127 amended (Replacement accreditation document)
Regulation 127(1) of the Principal Regulations is amended by omitting "give written notice to" and substituting "notify".
9. Regulation 288 amended (Replacement registration document)
Regulation 288(1) of the Principal Regulations is amended by omitting "give written notice to" and substituting "notify".
10. Regulation 459 amended (Asbestos removal supervisor must be present or readily available)
Regulation 459 of the Principal Regulations is amended as follows:(a) by inserting in paragraph (a) "asbestos removal" after "A";(b) by inserting in paragraph (b) "asbestos removal" after "B".
11. Chapter 8, Part 8.8: Heading amended
Part 8.8 of Chapter 8 of the Principal Regulations is amended by inserting in the heading to that Part "asbestos removal" after "A".
12. Regulation 513 amended (Replacement licence document)
Regulation 513(1) of the Principal Regulations is amended by omitting "give written notice to" and substituting "notify".
13. Schedule 3 amended (High Risk Work Licences and Classes of High Risk Work)
Schedule 3 to the Principal Regulations is amended as follows:(a) by inserting in column 3 after item 20 in Table 3.1 the following:
Use of a materials hoist
(b) by omitting "Turbine" from column 2 of item 28 in Table 3.1 and substituting "Steam turbine";(c) by inserting "steam" after "a" in column 3 of item 28 in Table 3.1 .
14. Schedule 4 amended (High Risk Work Licences – Competency Requirements)
Schedule 4 to the Principal Regulations is amended as follows:(a) by omitting "conduct concrete boom delivery operations" from column 3 of item 22 in Table 4.1 and substituting "operate a concrete placing boom";(b) by omitting "Turbine" from column 2 of item 28in Table 4.1 and substituting "Steam turbine";(c) by inserting "steam" after "a" in column 3 of item 28 in Table 4.1 .
15. Schedule 5 amended (Registration of Plant and Plant Designs)
Schedule 5 to the Principal Regulations is amended as follows:(a) by omitting item 1.4 from Part 1 and substituting the following item:

(b) by omitting item 1.8 from Part 1 and substituting the following item:

Amusement devices classified by Section 2.1 of AS 3533.1:2009 (Amusement rides and devices – Design and construction), except devices specified in clause 2(2).

(d) by omitting item 3.6 from Part 2 and substituting the following item:

EXPLANATORY NOTE

These regulations amend the Work Health and Safety Regulations 2012 by implementing nationally agreed changes to the model Work Health and Safety Regulations including –(a) amending the definitions of "concrete placing boom", "lift", "pressure piping", "tower crane" and "turbine"; and(b) removing the requirement for certain notifications to the regulator to be in writing; and(c) correcting references; and(d) making other minor amendments.
