Inland Fisheries (Seasons and Waters) Amendment Order 2018

I make the following order under section 197 of the Inland Fisheries Act 1995 .

1.   Short title

This order may be cited as the Inland Fisheries (Seasons and Waters) Amendment Order 2018 .

2.   Commencement

This order takes effect on the day on which the Inland Fisheries (Recreational Fishing) Amendment Regulations 2018 commence.

3.   Principal Order

In this order, the Inland Fisheries (Seasons and Waters) Order 1996 is referred to as the Principal Order.

4.    Clause 3 amended (Interpretation)

Clause 3(1) of the Principal Order is amended as follows:
(a) by inserting the following definition after the definition of grid reference :
junior angling development fishery has the same meaning as in the Inland Fisheries (Recreational Fishing) Regulations 2009.
(b) by omitting the definition of juvenile angling pond .

5.    Clause 4 amended (Taking acclimatised fish)

Clause 4(1)(f) of the Principal Order is amended as follows:
(a) by omitting from subparagraph (x) "Leven River from the Allison Bridge downstream to the seaward limit of that river" and substituting "River Leven from the confluence of Whisky Creek, delineated by a straight line between grid reference 422710E 5442177N and 422750E 5442142N downstream to the seaward limit of that river";
(b) by omitting from subparagraph (xii) "River Derwent from the Bridgewater Bridge downstream to the seaward limit of that river" and substituting "River Derwent from the A10 Road Bridge at grid reference 504630E 5263716N downstream to the seaward limit of that river".

6.    Clause 5 amended (Taking indigenous fish)

Clause 5(a)(iii) of the Principal Order is amended by omitting "Macquaria colonorum" and substituting "Percalates colonorum".

7.    Clause 6 amended (Taking fish in juvenile ponds)

Clause 6 of the Principal Order is amended as follows:
(a) by omitting "juvenile angling pond" and substituting "junior angling development fishery";
(b) by omitting "16" and substituting "18".

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the Inland Fisheries (Seasons and Waters) Order 1996 by –
(a) replacing the references to juvenile angling pond with references to junior angling development fishery and changing the age limit for taking fish from such waters from 16 to 18; and
(b) updating the scientific name for estuary perch; and
(c) prescribing a new boundary for taking acclimatised fish in the Leven River and the River Derwent.
