I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Court Security Act 2017 .

1.   Short title

These regulations may be cited as the Court Security Regulations 2018 .

2.   Commencement

These regulations take effect on the day on which the Court Security Act 2017 commences.

3.   Interpretation

In these regulations –
Act means the Court Security Act 2017 .

4.   Meaning of tribunal

For the purposes of the definition of tribunal in the Act, the following tribunals and bodies are prescribed to be a tribunal for the purposes of the Act:
(a) the Anti-Discrimination Tribunal established under section 12 of the Anti-Discrimination Act 1998 ;
(b) the Asbestos Compensation Tribunal established under section 129 of the Asbestos-Related Diseases (Occupational Exposure) Compensation Act 2011 ;
(c) the Forest Practices Tribunal established under section 34 of the Forest Practices Act 1985 ;
(d) the Guardianship and Administration Board established under section 7 of the Guardianship and Administration Act 1995 ;
(e) the Health Practitioners Tribunal established under section 7 of the Health Practitioners Tribunal Act 2010 ;
(f) the Legal Profession Board of Tasmania established under section 589 of the Legal Profession Act 2007 ;
(g) the Mental Health Tribunal established under section 167 of the Mental Health Act 2013 ;
(h) the Motor Accidents Compensation Tribunal established under section 12 of the Motor Accidents (Liabilities and Compensation) Act 1973 ;
(i) the Property Agents Board continued under section 5 of the Property Agents and Land Transactions Act 2016 ;
(j) the Property Agents Tribunal established in accordance with section 104 of the Property Agents and Land Transactions Act 2016 ;
(k) the Resource Management and Planning Appeal Tribunal established under section 5 of the Resource Management and Planning Appeal Tribunal Act 1993 ;
(l) the Workers Rehabilitation and Compensation Tribunal established under section 16 of the Workers Rehabilitation and Compensation Act 1988 .

5.   Possession of prohibited objects

For the purposes of section 10(2)(e) of the Act, a person may have possession of a prohibited object on court premises, or bring a prohibited object on to court premises, in the circumstances where –
(a) the prohibited object is a controlled substance; and
(b) the person in possession of the controlled substance is authorised, under any Act, to be in possession of the controlled substance.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations prescribe, for the purposes of the Court Security Act 2017  –
(a) specified tribunals and boards as falling within the scope of the Act; and
(b) circumstances where a person may be in possession of a controlled substance on court premises.
