Marine Farming Planning Amendment (Infringement Notices) Regulations 2017

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Marine Farming Planning Act 1995 .

1.   Short title

These regulations may be cited as the Marine Farming Planning Amendment (Infringement Notices) Regulations 2017 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Marine Farming Planning Regulations 2016 are referred to as the Principal Regulations.

4.    Schedule 2 amended (Infringement Notice Offences)

Schedule 2 to the Principal Regulations is amended by inserting after item 10 the following items:

10A. 

Impeding or obstructing execution of marine farming development plan, emergency plan or emergency order – section 91(1)(b)

10B. 

Contravening condition of marine farming development plan, emergency plan, emergency order or determination – section 91(1)(c)

4

10C. 

Contravening condition of lease – section 91(1)(d)
