Fisheries Amendment Rules 2017
I make the following rules under the Living Marine Resources Management Act 1995 .

These rules may be cited as the Fisheries Amendment Rules 2017 .
These rules take effect on 1 September 2017.
In these rules, the Fisheries Rules 2009 are referred to as the Principal Rules.
4. Rule 3 amended (Interpretation)
Rule 3 of the Principal Rules is amended as follows:(a) by omitting the definition of marine plant and substituting the following definition:marine plant has the same meaning as in the Fisheries (Marine Plant) Rules 2017 ;(b) by omitting the definition of native marine plant ;(c) by omitting the definitions of processed , processing premises and quantity ;(d) by omitting the definition of Undaria .
5. Rule 7 amended (Classes of fishing licences)
Rule 7(g) of the Principal Rules is amended by omitting subparagraphs (i) and (ii) and substituting the following subparagraphs:(i) fishing licence (introduced marine plant); or(ii) fishing licence (King Island kelp); or(iii) fishing licence (marine plant); or(iv) fishing licence (Undaria);
6. Rule 16 amended (Receipt for purchase of fish for sale or resale)
Rule 16(2) of the Principal Rules is amended by omitting paragraph (e) and substituting the following paragraph:(e) the name and distinguishing mark of the fishing vessel used to take the fish, if the person from whom the fish were obtained used a fishing vessel to take the fish;
7. Part 5 rescinded
Part 5 of the Principal Rules is rescinded.
8. Rule 15 amended (Marine nature reserve)
Rule 15(1) of the Principal Rules is amended as follows:(a) by omitting from paragraph (a) "or marine plant";(b) by omitting from paragraph (b) "or marine plant".
9. Schedule 3A amended (Infringement Notice Offences and Penalties)
Schedule 3A to the Principal Rules is amended by omitting items 38 , 39 , 40 , 41 , 42 , 43 , 44 , 45 and 46 .

EXPLANATORY NOTE
(This note is not part of the rule)
These rules amend the Fisheries Rules 2009 by –(a) removing certain provisions relating to marine plants consequent on the making of the Fisheries (Marine Plant) Rules 2017; and(b) making other minor amendments.
