Building Amendment Regulations 2017

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Building Act 2016 .

1.   Short title

These regulations may be cited as the Building Amendment Regulations 2017 .

2.   Commencement

These regulations take effect on 1 July 2017.

3.   Principal Regulations

In these regulations, the Building Regulations 2016 are referred to as the Principal Regulations.

4.    Regulation 8 amended (Director of Building Control may make determinations)

Regulation 8 of the Principal Regulations is amended as follows:

(a) by inserting the following paragraph after paragraph (g) :

(ga) the form and content of documents required under the Act, including specified documents, that are not otherwise prescribed in accordance with the Act;

(b) by omitting paragraph (k) and substituting the following paragraphs:

(k) the following matters in respect of a building certificate under regulation 83 :

(i) the content and form of an application for such a building certificate;

(ii) the means of verifying compliance of work to which an application for such a building certificate relates;

(iii) the content and form of such a building certificate;

(l) any additional requirements, or obligations, in respect of premises used, or intended to be used, for providing for consideration short-term or medium-term accommodation for persons away from their normal place of residence;

(m) the requirements, and procedures, for occupancy permits and temporary occupancy permits not otherwise covered under the Act.

5.    Schedule 5 amended (Infringement Notice Offences)

Schedule 5 to the Principal Regulations is amended as follows:

(a) by omitting

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Building Regulations 2016 by –

(a) empowering the Director of Building Control to make determinations in respect of documentary requirements, visitor accommodation, occupancy permits, temporary occupancy permits, and verification of work in relation to building certificates; and

(b) prescribing certain offences within those regulations as infringement notice offences and specifying the applicable penalties for those offences.
