Food Amendment Regulations 2016
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Food Act 2003 .

These regulations may be cited as the Food Amendment Regulations 2016 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Food Regulations 2012 are referred to as the Principal Regulations.
4. Regulation 4 amended (Incorporation of Food Standards Code)
Regulation 4 of the Principal Regulations is amended by omitting subregulation (2) and substituting the following subregulation:(2) Clause 4 of Standard 2.2.2, and Standard 4.2.5, of the Food Standards Code do not apply to (a) home egg production, as defined in the Primary Produce Safety (Egg) Regulations 2014 ; or(b) the sale of eggs, produced as part of home egg production, by the person responsible for the home egg production.

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations amend the Food Regulations 2012 by (a) correcting a referencing anomaly which inadvertently removed certain requirements on the sale of eggs; and(b) clarifying the applicable requirements on the sale of eggs in certain circumstances; and(c) restricting the exemption that allows the sale of unstamped eggs to eggs produced as part of home egg production.
