I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 40 of the Misuse of Drugs Act 2001 .

1.   Short title

This order may be cited as the Misuse of Drugs Order 2016 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Principal Act

In this order, the Misuse of Drugs Act 2001 is referred to as the Principal Act.

4.    Schedule 1 amended (Controlled substances and trafficable quantities)

Part 2 of Schedule 1 to the Principal Act is amended as follows:
(a) by inserting after item 74 the following:

74C. 

l-cyclohexyl-4-(1,2-diphenylethyl)piperazine (otherwise known as MT-45)

 
(b) by inserting after item 81A the following:

81M. 

3,4-dichloro-N-(2-(dimethylamino)cyclohexyl)-N-methylbenzamide (otherwise known as U-47700)

 
(c) by inserting after item 119 the following:

119M. 

Ethylnaphthidate (otherwise known as HDEP-28)

 
(d) by omitting item 120A and substituting the following:

120A. 

Ethylphenidate

(e) by omitting items 127A , 127B and 127C and substituting the following:

127A. 

2-fluoromethcathinone

25 grams (or 20 Units)

3-fluoromethcathinone

25 grams (or 20 Units)

(f) by inserting after item 127D the following:

EXPLANATORY NOTE

(This note is not part of the order)

This order amends Schedule 1 to the Misuse of Drugs Act 2001 by adding certain substances to the list of controlled drugs, correcting the name of certain substances on that list and specifying a trafficable quantity for certain substances on that list.
