Liquor Licensing (Infringement Notices) Amendment Regulations 2016

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Liquor Licensing Act 1990 .

1.   Short title

These regulations may be cited as the Liquor Licensing (Infringement Notices) Amendment Regulations 2016 .

2.   Commencement

These regulations take effect on the day on which the provisions of the Liquor Licensing Amendment Act 2015 commences.

3.   Principal Regulations

In these regulations, the Liquor Licensing (Infringement Notices) Regulations 2008 are referred to as the Principal Regulations.

4.    Regulation 4 amended (Offences under Act)

Regulation 4 of the Principal Regulations is amended as follows:

(a) by inserting in paragraph (a) "column 2 of the table in" after "in";

(b) by omitting from paragraph (b) " Schedule 1 " and substituting "column 3 of that table".

5.    Regulation 5 inserted

After regulation 4 of the Principal Regulations , the following regulation is inserted:

5.   Offences under Liquor Licensing Regulations 2016

For the purposes of section 223 of the Act –

(a) an offence under a provision of the Liquor Licensing Regulations 2016 specified in column 2 of the table in Schedule 2 is a prescribed offence; and

(b) the penalty specified in column 3 of that table in respect of that offence is the prescribed penalty for that offence.

6.    Schedule 1 substituted

Schedule 1 to the Principal Regulations is rescinded and the following Schedules are substituted:

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Liquor Licensing (Infringement Notices) Regulations 2008 by –

(a) revising the schedule of infringement notice offences consequent on the enactment of the Liquor Licensing Amendment Act 2015 and the Liquor Licensing Regulations 2016 ; and

(b) making other minor and consequential amendments.
