Local Government (Rates and Charges Remissions) Amendment Regulations 2016
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Local Government (Rates and Charges Remissions) Act 1991 .

These regulations may be cited as the Local Government (Rates and Charges Remissions) Amendment Regulations 2016 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Local Government (Rates and Charges Remissions) Regulations 2014 are referred to as the Principal Regulations.
4. Regulation 4 amended (Meaning of eligible pensioner)
Regulation 4(1) of the Principal Regulations is amended as follows:(a) by inserting ", or section 199 of the Military Rehabilitation and Compensation Act 2004 of the Commonwealth," after "Commonwealth" in the definition of totally and permanently incapacitated person ;(b) by omitting the definitions of war widow and war widower and substituting the following definitions:war widow means (a) a war widow receiving a pension under Part II or IV of the Veterans' Entitlements Act 1986 of the Commonwealth at a rate determined in accordance with section 30(1) of that Act; or(b) a person who is a wholly dependent partner of a person who is a deceased member, within the meaning of section 5 of the Military Rehabilitation and Compensation Act 2004 of the Commonwealth, to whom section 12 of that Act applies;war widower means (a) a war widower receiving a pension under Part II or IV of the Veterans' Entitlements Act 1986 of the Commonwealth at a rate determined in accordance with section 30(1) of that Act; or(b) a person who is a wholly dependent partner of a person who is a deceased member, within the meaning of section 5 of the Military Rehabilitation and Compensation Act 2004 of the Commonwealth, to whom section 12 of that Act applies.

EXPLANATORY NOTE

These regulations amend the definitions of "totally" and "permanently incapacitated person", "war widow" and "war widower" in the Local Government (Rates and Charges Remissions) Regulations 2014 and thereby amend the meaning of the definition of "eligible pensioner" for the purposes of the Local Government (Rates and Charges Remissions) Act 1991 .
