I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 4(1) of the Administrative Arrangements Act 1990 .

1.   Short title

This order may be cited as the Administrative Arrangements Amendment Order (No. 2) 2016 .

2.   Commencement

This order takes effect on 4 April 2016.

3.   Interpretation

The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were by-laws.

4.   Principal Order

In this order, the Administrative Arrangements Order 2016 is referred to as the Principal Order.

5.    Schedule 1 amended (Administration of Enactments)

Schedule 1 to the Principal Order is amended as follows:
(a) by omitting from the heading to Part 15 "MINISTER FOR POLICE AND EMERGENCY MANAGEMENT" and substituting "MINISTER FOR POLICE, FIRE AND EMERGENCY MANAGEMENT";
(b) by omitting

DEPARTMENT OF POLICE AND EMERGENCY MANAGEMENT

from Part 15 and substituting the following item:

DEPARTMENT OF POLICE, FIRE AND EMERGENCY MANAGEMENT

(c) by inserting in Part 15 after

Firearms Act 1996

the following item:

Fire Service Act 1979

(d) by omitting the following items

TASMANIA FIRE SERVICE

Fire Service Act 1979

from Part 15 ;
(e) by omitting

Police Service Act 2003

in so far as it relates to matters relating to the appointment to, and employment in, the office of Commissioner of Police (otherwisesee Department of Police and Emergency Management under the Minister for Police and Emergency Management)

from Part 16 and substituting the following items:

Police Service Act 2003

in so far as it relates to matters relating to the appointment to, and employment in, the office of Commissioner of Police (otherwisesee Department of Police, Fire and Emergency Management under the Minister for Police, Fire and Emergency Management)

Displayed and numbered in accordance with the Rules Publication Act 1953.

This order is administered in the Department of Premier and Cabinet.

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the Administrative Arrangements Order 2016 by renaming the Department of Police and Emergency Management to the Department of Police, Fire and Emergency Management under the Minister for Police, Fire and Emergency Management, and by moving administrative responsibility for the Fire Service Act 1979 to that Department.
