Road Amendment (Learner and Provisional Licensee Speed-limits) Rules 2014

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following rules under section 31A of the Traffic Act 1925 .

1.   Short title

These rules may be cited as the Road Amendment (Learner and Provisional Licensee Speed-limits) Rules 2014 .

2.   Commencement

These rules take effect on 2 March 2015.

3.   Principal Rules

In these rules, the Road Rules 2009 are referred to as the Principal Rules.

4.    Rule 373 substituted

Rule 373 of the Principal Rules is rescinded and the following rule is substituted:

373.   Speed-limits for learners and provisional licensees

(1)  A driver holding one of the following licences must not drive, under the authority of that licence, at a speed exceeding 80 kilometres per hour:
(a) an L1 learner licence;
(b) a motor cycle licence issued as a learner licence;
(c) a motor cycle licence issued as a P1 provisional licence.
(2)  A driver holding a learner licence or a P1 provisional licence, other than a licence referred to in subrule (1) , must not drive under the authority of that licence at a speed exceeding –
(a) on a length of road where the speed-limit applying, under these rules, to a driver with a full car licence is 100 kilometres per hour, 90 kilometres per hour; or
(b) on a length of road where the speed-limit applying, under these rules, to a driver with a full car licence is 110 kilometres per hour, 100 kilometres per hour.
(3)  In this rule –
car licence has the same meaning as in the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010 ;
full car licence means a car licence that has been issued as a full licence;
L1 learner licence has the same meaning as in the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010 ;
motor cycle licence has the same meaning as in the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010 ;
P1 provisional licence has the same meaning as in the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010 .

5.    Schedule 5 amended (Dictionary)

Clause 1 of Schedule 5 to the Principal Rules is amended by omitting the definition of P1 provisional licence .
