Heavy Vehicle National Law (Tasmania) Amendment Regulations 2014

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Heavy Vehicle National Law (Tasmania) Act 2013 .

1.   Short title

These regulations may be cited as the Heavy Vehicle National Law (Tasmania) Amendment Regulations 2014 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Heavy Vehicle National Law (Tasmania) Regulations 2014 are referred to as the Principal Regulations.

4.    Regulation 9 inserted

After regulation 8 of the Principal Regulations , the following regulation is inserted:

9.   Transitional permit

(1)  In this regulation –
vehicle operations permit means a permit under Division 3 of Part 6 of the Vehicle and Traffic (Vehicle Operations) Regulations 2001 that –
(a) on the commencement day, was taken under section 748 of the Heavy Vehicle National Law (Tasmania) to have been made under that Law; and
(b) has an expiry date between 31 December 2014 and 31 August 2015 (inclusive).
(2)  The holder of a vehicle operations permit (the original permit) is taken, on the expiry of that permit, to have been issued with a mass or dimension exemption (permit) under section 122 of the Heavy Vehicle National Law (Tasmania) –
(a) for the period commencing on the expiry of the original permit and ending on 31 December 2015; and
(b) subject to the same terms and conditions as those that applied to the original permit immediately before the expiry of that permit.
(3)  For the purposes of the Heavy Vehicle National Law (Tasmania), the document issued to the person under regulation 49 of the Vehicle and Traffic (Vehicle Operations) Regulations 2001 is taken to be the document given to that person under section 127 of the Heavy Vehicle National Law (Tasmania).

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Heavy Vehicle National Law (Tasmania) Regulations 2014 by providing that a person who held a mass or dimension limit exemption permit under the Vehicle and Traffic (Vehicle Operations) Regulations 2001 may, in certain circumstances, be taken to hold a mass or dimension exemption (permit) under the Heavy Vehicle National Law (Tasmania) until 31 December 2015.
