Inland Fisheries (Seasons and Waters) Amendment Order 2014
I make the following order under section 197 of the Inland Fisheries Act 1995 .

This order may be cited as the Inland Fisheries (Seasons and Waters) Amendment Order 2014 .
This order takes effect on the day on which its making is notified in the Gazette.
In this order, the Inland Fisheries (Seasons and Waters) Order 1996 is referred to as the Principal Order.
4. Clause 4 amended (Taking of acclimatised fish)
Clause 4 of the Principal Order is amended as follows:(a) by omitting subparagraph (ii) from subclause (1)(b) ;(b) by omitting from subclause (1)(b)(viii) "2 white posts on" and substituting "the";(c) by omitting from subclause (1)(b)(ix) "2 white posts on" and substituting "the";(d) by omitting from subclause (1)(f)(i) "one hour after" and substituting "three hours after";(e) by omitting from subclause (1)(f)(ii) "one hour after" and substituting "three hours after";(f) by omitting from subclause (1)(f)(iiia) "one hour after" and substituting "three hours after";(g) by omitting from subclause (2)(ca) "one hour after" and substituting "three hours after";(h) by omitting from subclause (2)(d) "one hour after sunset." and substituting "three hours after sunset; and";(i) by inserting the following paragraph after paragraph (d) in subclause (2) :(e) at Lake Crescent from one hour before sunrise to three hours after sunset.
5. Clause 8 amended (Prohibition on taking fish)
Clause 8 of the Principal Order is amended as follows:(a) by omitting paragraph (f) and substituting the following paragraph:(f) waters flowing into Lake Crescent, except the section of waters, in the canal between Lake Sorell and Lake Crescent, below Interlaken Road;(b) by omitting paragraph (h) ;(c) by omitting paragraphs (k) and (l) ;(d) by omitting paragraphs (n) and (o) ;(e) by omitting paragraph (u) and substituting the following paragraph:(u) waters of the Dogs Head Creek, Silver Plains Creek and Mountain Creek that flow into Lake Sorell;(f) by omitting from paragraph (v) " paragraphs (a) , (c) , (e) and (i) " and substituting " paragraphs (a) , (c) , (e) , (i) and (u) ".

EXPLANATORY NOTE

This order amends the Inland Fisheries (Seasons and Waters) Order 1996 by clarifying –(a) when and where acclimatised fish can be taken in certain circumstances; and(b) when it is prohibited to take fish in certain circumstances.
