Inland Fisheries (Recreational Fishing) Amendment Regulations 2014

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Inland Fisheries Act 1995 .

1.   Short title

These regulations may be cited as the Inland Fisheries (Recreational Fishing) Amendment Regulations 2014 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Inland Fisheries (Recreational Fishing) Regulations 2009 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3(1) of the Principal Regulations is amended as follows:
(a) by omitting "2 white posts on the opposite points of the shore" from the definition of Canal Bay and substituting "grid reference E476050 N5362584 and grid reference E476072 N5361781";
(b) by inserting the following definition after the definition of goldfish :
grid reference means the grid reference taken from the Universal Grid Reference System used in Tasmania and based on the Geocentric Datum of Australia (also known as the "the GDA" or "GDA 94") as defined in the Commonwealth Gazette No. GN 35, 6 September 1995;
(c) by omitting "2 white posts on the opposite points of the shore" from the definition of Tods Corner and substituting "grid reference E481761 N5354650 and grid reference E481847 N5356012".

5.    Regulation 16 amended (Minimum size limits)

Regulation 16(3) of the Principal Regulations is amended as follows:
(a) by inserting the following paragraph after paragraph (e) :
(ea) Dee Lagoon;
(b) by inserting the following paragraphs after paragraph (k) :
(ka) Lake Crescent;
(kb) Lake Kara;

6.    Regulation 17 amended (Maximum size limits)

Regulation 17(2) of the Principal Regulations is amended as follows:
(a) by omitting "600 millimetres" and substituting "500 millimetres";
(b) by inserting the following paragraph after paragraph (d) :
(da) Dee Lagoon;
(c) by inserting the following paragraphs after paragraph (h) :
(ha) Lake Crescent;
(hb) Lake Kara;

7.    Regulation 24 amended (Use of baits and lures)

Regulation 24(2) of the Principal Regulations is amended by omitting paragraph (h) .

8.    Schedule 1 amended (Waters for Taking Indigenous Fish)

Division 2 of Schedule 1 to the Principal Regulations is amended as follows:
(a) by omitting "2 white posts on opposite banks of the river, approximately 400 metres above the Bass Highway Bridge" from column 2 of item 3 in the table and substituting "an imaginary line drawn between grid reference E414414 N5452064 and grid reference E414414 N5452173";
(b) by omitting "2 posts approximately 1.6 kilometres from the river mouth" from column 2 of item 4 in the table and substituting "an imaginary line drawn between grid reference E570959 N5261529 and grid reference E570982 N5261529";
(c) by omitting "2 white posts on opposite banks of the river, approximately 400 metres above the Bass Highway Bridge" from column 2 of item 7 in the table and substituting "an imaginary line drawn between grid reference E402393 N5455851 and grid reference E402482 N5455819".

9.    Schedule 5 amended (Bag Limits)

Schedule 5 to the Principal Regulations is amended as follows:
(a) by inserting after item 10 the following item:

(c) by inserting after item 30 the following item:

Lake Kara

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Inland Fisheries (Recreational Fishing) Regulations 2009 by –
(a) clarifying the boundaries of certain areas of inland waters; and
(b) removing references to areas that are no longer inland waters; and
(c) amending the maximum and minimum sizes, and bag limits, that apply to certain inland waters.
