Poisons Amendment Regulations (No. 3) 2013

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

PART 1 - Preliminary

1.   Short title

These regulations may be cited as the Poisons Amendment Regulations (No. 3) 2013 .

2.   Commencement

(1)  Except as provided in this regulation, these regulations take effect on the day on which the making of these regulations is notified in the Gazette.
(2)  Part 3 takes effect 6 months after the day on which the making of these regulations is notified in the Gazette.
PART 2 - Poisons Regulations 2008 Amended

3.   Principal Regulations

In this Part, the Poisons Regulations 2008 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3(1) of the Principal Regulations is amended by inserting after the definition of optometrist the following definition:
oral health therapist means a person registered under the Health Practitioner Regulation National Law (Tasmania) in the dental profession as an oral health therapist;

5.    Regulation 23 amended (Dispensing of narcotic substances (S8))

Regulation 23(20) of the Principal Regulations is amended by omitting "package or container in which the narcotic substance is supplied a reference to the entry in the prescription book of the dispensing of that prescription" and substituting "label on the container of the narcotic substance the prescription reference number appearing in the approved recording system and with such other particulars as are prescribed in regulation 84(2) ".

6.    Regulation 46 amended (Dispensing prescriptions for restricted substances (S4))

Regulation 46(8)(d) of the Principal Regulations is amended by omitting "identifying letter or number of the prescription" and substituting "prescription reference number".

7.    Regulation 54 amended (Administration of salbutamol (S3))

Regulation 54(4)(b) of the Principal Regulations is amended by omitting "Asthma Foundation of Tasmania" and substituting "Asthma Foundation of Victoria or St John Ambulance".

8.    Regulation 64 amended (Prescribed persons for section 38(1)(i) of Act)

Regulation 64 of the Principal Regulations is amended as follows:
(a) by inserting in paragraph (a) "or an oral health therapist" after "therapist";
(b) by inserting in paragraph (a) "or oral health" after "of dental";
(c) by omitting from paragraph (c) "Health." and substituting "Health; and";
(d) by inserting the following paragraph after paragraph (c) :
(d) a person who is a registered nurse and who satisfies the requirements of paragraph (c)(i) and (ii) may supervise the administration of a vaccine listed in Schedule 4 to the Poisons List in accordance with a vaccination program approved by the Director of Public Health, by another registered nurse who –
(i) is undertaking an educational program approved by the Secretary relating to the administration of vaccines; or
(ii) has been approved by the Director of Public Health to administer vaccines specified by the Director.

9.    Regulation 79 amended (Application of provisions of Uniform Standard)

Regulation 79(1) of the Principal Regulations is amended by omitting "and J" and substituting ", J and L".
PART 3 - Poisons Regulations 2008 Further Amended

10.   Principal Regulations

In this Part, the Poisons Regulations 2008 are referred to as the Principal Regulations.

11.    Regulation 84 amended (Labelling of dispensed medicines)

Regulation 84 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1) " subregulation (2) " and substituting "Appendix L to the Uniform Standard and subregulation (2)";
(b) by omitting subregulations (2) , (3) and (4) and substituting the following subregulation:
(2)  Where a container contains medicine that –
(a) is for internal use; and
(b) contains a substance specified in Appendix K to the Uniform Standard –
the labelling of the container is to include a warning statement in the form, or to the effect, of warning statement 39 or warning statement 40 in Part 1 of Appendix F to the Uniform Standard.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Poisons Regulations 2008 in relation to –
(a) the prescription of oral health therapists for the purposes of section 38(1)(i) of the Poisons Act 1971 ; and
(b) the supervision of the administration of immunisations by certain registered nurses; and
(c) the recognition of St John Ambulance and the Asthma Foundation of Victoria as approved providers of training in the administration of salbutamol; and
(d) the labelling of certain medicines.
