Poisons Amendment Regulations (No. 2) 2013
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

These regulations may be cited as the Poisons Amendment Regulations (No. 2) 2013 .
These regulations take effect on 1 July 2013.
In these regulations, the Poisons Regulations 2008 are referred to as the Principal Regulations.
4. Regulation 3 amended (Interpretation)
Regulation 3(1) of the Principal Regulations is amended as follows:(a) by omitting the definitions of Polytechnic , Polytechnic principal and Polytechnic student ;(b) by omitting "Act." from the definition of specified psychotropic substance and substituting "Act;";(c) by inserting the following definitions after the definition of specified psychotropic substance :TasTAFE means TasTAFE created by section 56 of the Training and Workforce Development Act 2013 ;TasTAFE chief executive officer means the chief executive officer of TasTAFE appointed under section 66 of the Training and Workforce Development Act 2013 .
5. Regulation 53 amended (Supply of potent substances by pharmaceutical chemists)
Regulation 53 of the Principal Regulations is amended as follows:(a) by omitting "the Polytechnic." from the definition of school first aid kit in subregulation (1AA) and substituting "TasTAFE.";(b) by omitting from subregulation (1)(c) "Polytechnic principal;" and substituting "TasTAFE chief executive officer;";(c) by omitting from subregulation (2) "Polytechnic principal," and substituting "TasTAFE chief executive officer,".
6. Regulation 54 amended (Administration of salbutamol (S3))
Regulation 54 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (1) "the Polytechnic" and substituting "TasTAFE";(b) by omitting from subregulation (2) "Polytechnic principal" and substituting "TasTAFE chief executive officer";(c) by omitting from subregulation (3) "Polytechnic principal" and substituting "TasTAFE chief executive officer";(d) by omitting from subregulation (3) "the Polytechnic.." and substituting "TasTAFE.".
7. Regulation 95C amended (Administration of certain substances by TasTAFE employees)
Regulation 95C of the Principal Regulations is amended as follows:(a) by omitting the definitions of Polytechnic employee and post-Year 10 education and training from subregulation (1) and substituting the following definitions:post-Year 10 education and training means education and training that is usually undertaken by persons following the completion of the year of secondary education commonly known as Year 10, but does not include higher education, within the meaning of the Tasmanian Qualifications Authority Act 2003 ;TasTAFE employee means a person appointed or employed for the purposes of TasTAFE, as specified in section 69 of the Training and Workforce Development Act 2013 .(b) by omitting from subregulation (2) "Polytechnic" first occurring and substituting "TasTAFE";(c) by omitting from subregulation (2)(a)(i) "Polytechnic" and substituting "TasTAFE";(d) by omitting from subregulation (2)(a)(ii)(A) "principal;" and substituting "TasTAFE chief executive officer;";(e) by omitting from subregulation (2)(a)(ii)(B) "chief executive officer of the Polytechnic;" and substituting "TasTAFE chief executive officer;";(f) by omitting from subregulation (2)(b) "Polytechnic" and substituting "TasTAFE";(g) by omitting from subregulation (2)(e) "Polytechnic" and substituting "TasTAFE";(h) by omitting from subregulation (2)(f) "Polytechnic" and substituting "TasTAFE".
8. Regulation 95G amended (Administration of certain substances by carers)
Regulation 95G(2)(d) of the Principal Regulations is amended by omitting "Polytechnic" and substituting "TasTAFE".

EXPLANATORY NOTE

These regulations amend the Poisons Regulations 2008 to substitute references to TasTAFE for references to the Tasmanian Polytechnic consequent on the repeal of the Education and Training (Tasmanian Polytechnic) Act 2008 by the Training and Workforce Development (Repeals and Consequential Amendments) Act 2013 and the creation of TasTAFE by the Training and Workforce Development Act 2013 .
