Police Offences Amendment Regulations 2013

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Police Offences Act 1935 .

1.   Short title

These regulations may be cited as the Police Offences Amendment Regulations 2013 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Police Offences Regulations 2007 are referred to as the Principal Regulations.

4.    Regulation 3A amended (Public places where liquor consumption prohibited)

Regulation 3A of the Principal Regulations is amended as follows:

(a) by omitting from paragraph (a) "Crown";

(b) by omitting from paragraph (b) "Gardens." and substituting "Gardens;";

(c) by inserting the following paragraphs after paragraph (b) :

(c) the area of land specified in Part 3 of Schedule 1 and known as St Davids Park;

(d) the area of land specified in Part 8 of Schedule 1 and known as North Hobart Cultural Park and Skate Park.

5.    Regulation 4 amended (Public places where liquor consumption restricted)

Regulation 4 of the Principal Regulations is amended as follows:

(a) by omitting from subregulation (2)(a) "Crown";

(b) by omitting from subregulation (2)(b) "Crown";

(c) by omitting paragraph (c) from subregulation (2) ;

(d) by omitting from subregulation (2)(e) "Crown";

(e) by omitting paragraph (f) from subregulation (2) and substituting the following paragraphs:

(f) the area of land specified in Part 6 of Schedule 1 and known as Tasman Monument;

(g) the area of land specified in Part 9 of Schedule 1 and known as John Doggett Park;

(h) the area of land specified in Part 10 of Schedule 1 and known as Soundy Park;

(i) the area of land specified in Part 11 of Schedule 1 and known as Hobart Regatta Grounds;

(j) the area of land specified in Part 12 of Schedule 1 and known as Hobart Rivulet Linear Park;

(k) the area of land specified in Part 13 of Schedule 1 and known as University Rose Gardens.

(f) by omitting from subregulation (3) " (c) ,";

(g) by inserting the following subregulation after subregulation (4) :

(5)  For the purposes of the public places specified in paragraphs (g) , (h) , (i) , (j) and (k) of subregulation (2) , the times are every day of the year between the hours of 8 p.m. and 8 a.m. on the following day.

6.    Schedule 1 amended (Public Places)

Schedule 1 to the Principal Regulations is amended as follows:

(a) by omitting from Part 1 "Crown";

(b) by omitting from Part 2 "Crown";

(c) by omitting from Part 3 "Crown";

(d) by omitting from Part 4 "Crown";

(e) by omitting from Part 5 "Crown";

(f) by omitting from Part 6 "Crown";

(g) by inserting the following Parts after Part 7 :

PART 8 - North Hobart Cultural Park and Skate Park

All that land comprising 7 058 square metres, shown as Lot 1 and shaded and bounded by a heavy black line on Plan 9518 in the Central Plan Register, a reduced copy of which is set out, by way of illustration only, in Part 8 of Schedule 2 .

PART 9 - John Doggett Park

All that land comprising approximately 5 830 square metres, shown as Lot 1 and shaded and bounded by a heavy black line on Plan 9544 in the Central Plan Register, a reduced copy of which is set out, by way of illustration only, in Part 9 of Schedule 2 .

PART 10 - Soundy Park

All that land comprising 6 898 square metres, shown as Lot 1 and shaded and bounded by a heavy black line on Plan 9521 in the Central Plan Register, a reduced copy of which is set out, by way of illustration only, in Part 10 of Schedule 2 .

PART 11 - Hobart Regatta Grounds

All that land comprising approximately 8.195 hectares, shown as Lots 1 and 2 and shaded and bounded by heavy black lines on Plan 9519 in the Central Plan Register, a reduced copy of which is set out, by way of illustration only, in Part 11 of Schedule 2 .

PART 12 - Hobart Rivulet Linear Park

All that land comprising approximately 4.007 hectares, shown as Lots 1, 2 and 3 and shaded and bounded by heavy black lines on Plans 9522, 9523 and 9524 in the Central Plan Register, reduced copies of which are set out, by way of illustration only, in Part 12 of Schedule 2 .

PART 13 - University Rose Gardens

All that land comprising 9 260 square metres, shown as Lot 1 and shaded and bounded by a heavy black line on Plan 9520 in the Central Plan Register, a reduced copy of which is set out, by way of illustration only, in Part 13 of Schedule 2 .

7.    Schedule 2 amended (Plans)

Schedule 2 to the Principal Regulations is amended by inserting after Part 7 the following Parts:

PART 8 - North Hobart Cultural Park and Skate Park

PART 9 - John Doggett Park

PART 10 - Soundy Park

PART 11 - Hobart Regatta Grounds

PART 12 - Hobart Rivulet Linear Park

PART 13 - University Rose Gardens

Displayed and numbered in accordance with the Rules Publication Act 1953.

These regulations are administered in the Department of Police and Emergency Management.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Police Offences Regulations 2007 by making it an offence to consume liquor, or be in possession of an opened or unsealed container of liquor, in the public places specified in the regulations during the periods and at the times specified in the regulations.
