Local Government Order (No. 2) 2012

I make the following order under section 89B(8) of the Local Government Act 1993 .

1.   Short title

This order may be cited as the Local Government Order (No. 2) 2012 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

In this order –

Act means the Local Government Act 1993 .

4.   Relevant percentage

(1)  For the purposes of sections 90(5)(a) and 107(2B)(a) of the Act, the relevant percentage in respect of the Central Highlands Council for the 2012-2013 financial year is 67 per cent.

(2)  For the purposes of sections 90(5)(b) and 107(2B)(b) of the Act, the relevant percentage in respect of the Central Highlands Council is as follows:

(a) 59 per cent, for the 2013-2014 financial year;

(b) 51 per cent, for the 2014-2015 financial year;

(c) 43 per cent, for the 2015-2016 financial year.

This order is administered in the Department of Premier and Cabinet.

EXPLANATORY NOTE

(This note is not part of the order)

This order determines –

(a) for the purposes of sections 90(5)(a) and 107(2B)(a) of the Local Government Act 1993 , the relevant percentage that applies to the Central Highlands Council in respect of the 2012-2013 financial year; and

(b) for the purposes of sections 90(5)(b) and 107(2B)(b) of that Act, the relevant percentage that applies to that Council in respect of the 2013-2014, 2014-2015 and 2015-2016 financial years.
