Defamation Order 2012

I make the following order under section 35 of the Defamation Act 2005 .

1.   Short title

This order may be cited as the Defamation Order 2012 .

2.   Commencement

This order takes effect on 1 July 2012.

3.   Interpretation

In this Order –

Act means the Defamation Act 2005 ;

maximum damages amount has the same meaning as in section 35(1) of the Act.

4.   Maximum damages amount

For the purposes of section 35(1) of the Act, the maximum damages amount that is to apply from 1 July 2012 is declared to be $339 000.

EXPLANATORY NOTE

This order, for the purposes of section 35(1) of the Defamation Act 2005 , declares $339 000 to be the maximum amount of damages for non-economic loss that may be awarded from 1 July 2012 in defamation proceedings.
