Public Health (Tobacco Advertisements) Order 2012
I make the following order under section 70(2)(d) of the Public Health Act 1997 .

This order may be cited as the Public Health (Tobacco Advertisements) Order 2012 .
This order takes effect on the day on which its making is notified in the Gazette.
In this order –Act means the Public Health Act 1997 .
A tobacco advertisement that is displayed, published or broadcast in accordance with any relevant guidelines under the Act is declared to be a matter for the purposes of section 70(2)(d) of the Act.
Displayed and numbered in accordance with the Rules Publication Act 1953.
Notified in the Gazette on 11 April 2012
This order is administered in the Department of Health and Human Services.
EXPLANATORY NOTE
(This note is not part of the order)
This order has the effect of providing that the prohibition contained in section 70(1) of the Public Health Act 1997 , relating to the display, publication and broadcast of certain tobacco advertisements, does not apply if the display, publication or broadcast is done in accordance with relevant guidelines under that Act.
