Poisons List Amendment Order (No. 3) 2011

I make the following order under section 15(1) of the Poisons Act 1971 .

1.   Short title

This order may be cited as the Poisons List Amendment Order (No. 3) 2011 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Principal Order

In this order, the Poisons List Order 2001 is referred to as the Principal Order.

4.    Schedule 2 amended (Medicinal Poisons)

Schedule 2 to the Principal Order is amended as follows:
(a) by omitting item 2053 and substituting the following:

2053. 

Fexofenadine in preparations for oral use except in preparations for the treatment of seasonal allergic rhinitis in adults and children 12 years of age and over when –

 

(a) in a primary pack containing 10 dosage units or fewer and not more than 5 days' supply; and

 

(b) labelled with a recommended daily dose not exceeding 120mg of fexofenadine.

(b) by omitting item 2098 .

5.    Schedule 4 amended (Restricted Substances)

Schedule 4 to the Principal Order is amended as follows:
(a) by inserting after item 40067 the following:

40067M. 

5-aminolevulinic acid.

(b) by inserting after item 40232 the following:

40232M. 

Cabazitaxel.

(c) by inserting after item 40273 the following:

40273F. 

Catumaxomab.

(d) by inserting after item 40286 the following:

40286M. 

Cefquinome.

(e) by omitting item 40639 and substituting the following:

40639. 

Fexofenadine except –

 

(a) when included in Schedule 2 ; or

 

(b) in preparations for the treatment of seasonal allergic rhinitis in adults and children 12 years of age and over when –

6.    Schedule 5 amended (Domestic Poisons)

Schedule 5 to the Principal Order is amended as follows:
(a) by inserting after item 5139 the following:

Flazasulfuron.

(b) by inserting after item 5198 the following:

5198B. 

Mesotrione.

(c) by inserting after item 5287 the following:

5287M. 

Saflufenacil in water-dispersible granule preparations.

7.    Schedule 6 amended (Agricultural and Industrial Poisons)

Schedule 6 to the Principal Order is amended as follows:
(a) by inserting after paragraph (e) in item 6117 the following:

6118. 

Derquantel.

(b) by inserting after item 6238 the following:

6238M. 

Laureth carboxylic acids (excluding their salts and derivatives) except –

 

(a) in leave-on preparations containing 1.5% or less of laureth carboxylic acids; or

 

(b) in wash-off preparations containing 30% or less of laureth carboxylic acids and, if containing more than 5% of laureth carboxylic acids, when labelled with a warning to the following effect:

 

IF IN EYES WASH OUT IMMEDIATELY WITH WATER; or

 

(c) in other preparations containing 30% or less of laureth carboxylic acids and, if containing more than 5% of laureth carboxylic acids, when labelled with warnings to the following effect:

 

IF IN EYES WASH OUT IMMEDIATELY WITH WATER;

 

IF SKIN OR HAIR CONTACT OCCURS, REMOVE CONTAMINATED CLOTHING AND FLUSH SKIN AND HAIR WITH RUNNING WATER.

(d) by omitting item 6278 and substituting the following:

Naphthalene (excluding its derivatives) except in liquid hydrocarbons as an impurity.

(e) by inserting after paragraph (f) in item 6354 the following:

Pyroxasulfone in water-dispersible granule preparations when for pre-emergence herbicide use.

(f) by inserting after paragraph (c) in item 6372 the following:

Sodium lauryl sulfate (excluding its salts and derivatives) except –

 

(a) in wash-off preparations containing 30% or less of sodium lauryl sulfate and, if containing more than 5% of sodium lauryl sulfate, when labelled with a warning to the following effect:

 

IF IN EYES WASH OUT IMMEDIATELY WITH WATER; or

 

(b) in leave-on preparations containing 1.5% or less of sodium lauryl sulfate; or

 

(c) in toothpaste and oral hygiene preparations containing 5% or less of sodium lauryl sulfate; or

 

(d) in other preparations for animal use containing 2% or less of sodium lauryl sulfate; or

 

(e) in other preparations containing 30% or less of sodium lauryl sulfate and, if containing more than 5% of sodium lauryl sulfate, when labelled with warnings to the following effect:

 

IF IN EYES WASH OUT IMMEDIATELY WITH WATER;

 

IF SKIN OR HAIR CONTACT OCCURS, REMOVE CONTAMINATED CLOTHING AND FLUSH SKIN AND HAIR WITH RUNNING WATER.

8.    Schedule 7 amended (Dangerous Poisons)

Schedule 7 to the Principal Order is amended as follows:
(a) by inserting after item 7192 in Part 1 the following:

7192F. 

Pyroxasulfone except when included in Schedule 6 .

(b) by omitting item 7192S from Part 1 and substituting the following:

7192S. 

Saflufenacil except when included in Schedule 5 .

(c) by inserting after item 7523M in Part 2 the following:

7523T. 

Diethylhexyl phthalate for cosmetic use.

This order amends the Poisons List Order 2001 by incorporating changes recommended by the National Drugs and Poisons Schedule Committee in the Standard for the Uniform Scheduling of Medicines and Poisons No. 2, Amendments Nos. 2 and 3.
