Local Government (General) Amendment Regulations 2011

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Local Government Act 1993 .

1.   Short title

These regulations may be cited as the Local Government (General) Amendment Regulations 2011 .

2.   Commencement

These regulations take effect on 1 January 2012.

3.   Principal Regulations

In these regulations, the Local Government (General) Regulations 2005 are referred to as the Principal Regulations.

4.    Regulation 37 amended (Compulsory acquisition of land)

Regulation 37 of the Principal Regulations is amended by omitting paragraph (b) and substituting the following paragraphs:
(b) the establishment of, or extension to, a works depot, pound or plant nursery;
(ba) the establishment of, or extension to –
(i) any education and care service premises, within the meaning of the Education and Care Services National Law (Tasmania), other than any premises for a family day care service, within the meaning of that Law; or
(ii) a child care centre within the meaning of the Child Care Act 2001 ;

5.   Rescission of regulations

These regulations are rescinded on the one hundred and eightieth day from the day on which they take effect.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Local Government (General) Regulations 2005 , consequent on the enactment of the Education and Care Services National Law (Application) Act 2011 , to provide that a council under section 176 of the Local Government Act 1993 may acquire land for the purposes of certain education and care service premises within the meaning of the Education and Care Services National Law, as well as for the purposes of a child care centre within the meaning of the Child Care Act 2001 .
