Mineral Resources Amendment Regulations (No. 2) 2011

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Mineral Resources Development Act 1995 .

1.   Short title

These regulations may be cited as the Mineral Resources Amendment Regulations (No. 2) 2011 .

2.   Commencement

These regulations take effect on 1 January 2012.

3.   Principal Regulations

In these regulations, the Mineral Resources Regulations 2006 are referred to as the Principal Regulations.

4.    Regulation 7 amended (Prescribed rates of royalty)

Regulation 7 of the Principal Regulations is amended as follows:
(a) by omitting the formula from subregulation (3) and substituting the following formula:

(b) by omitting from subregulation (4) "5%" and substituting "5.35%";
(c) by omitting from subregulation (5) "1.6%" and substituting "1.9%";
(d) by omitting the formula from the definition of net sales royalty in subregulation (7) and substituting the following formula:

5.    Schedules 1 , 2 and 3 amended

Schedules 1 , 2 and 3 to the Principal Regulations are rescinded and the following is substituted:

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Mineral Resources Regulations 2006 by increasing –
(a) the prescribed rates of royalty payable by lessees and licensees in respect of minerals; and
(b) the fees specified in Schedule 2 to those regulations; and
(c) the rent payable for land over which licences and leases are granted.
