Building Amendment Regulations 2011

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Building Act 2000 .

1.   Short title

These regulations may be cited as the Building Amendment Regulations 2011 .

2.   Commencement

These regulations take effect on 29 August 2011.

3.   Principal Regulations

In these regulations, the Building Regulations 2004 are referred to as the Principal Regulations.

4.    Regulation 18 amended (Granting of building permits)

Regulation 18(1) of the Principal Regulations is amended as follows:
(a) by inserting the following paragraph after paragraph (c) :
(ca) a certificate of likely compliance has been granted in respect of the development and states that the development –
(i) does not require a planning permit under Part 4 of the Land Use Planning and Approvals Act 1993 ; and
(ii) is not prohibited by a planning scheme, or interim order in force, under the Land Use Planning and Approvals Act 1993 ;
(b) by omitting paragraph (ea) and substituting the following paragraph:
(ea) in the case of an application by an owner builder, a copy has been obtained of the certificate of likely compliance, granted for the building work that is the subject of the application;
(c) by omitting paragraph (f) .

5.    Regulation 19 amended (Permit for staged works)

Regulation 19(2) of the Principal Regulations is amended by omitting "building permit" second occurring and substituting "permission".

6.    Regulation 20 amended (Distribution of documents)

Regulation 20(1)(b)(i) of the Principal Regulations is amended by inserting "each page of" after "endorse".

7.    Regulation 35 amended (Infringement notices)

Regulation 35(3) of the Principal Regulations is amended by omitting "or Director is to forward a copy of it to the authorised body who accredited the building practitioner" and substituting "is to forward a copy of it to the Director".

8.    Regulation 48 amended (Safety and health records to be kept)

Regulation 48(4) of the Principal Regulations is amended by omitting "permit authority" first occurring and substituting "an authorised person".

EXPLANATORY NOTE

These regulations amend the Building Regulations 2004 by –
(a) revising the matters that a permit authority is to take into account when considering an application for a building permit; and
(b) making minor amendments of an administrative nature.
