Security and Investigations Agents Amendment Regulations 2011

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Security and Investigations Agents Act 2002 .

1.   Short title

These regulations may be cited as the Security and Investigations Agents Amendment Regulations 2011 .

2.   Commencement

These regulations take effect on the day on which the Security and Investigations Agents Amendment Act 2010 commences.

3.   Principal Regulations

In these regulations, the Security and Investigations Agents Regulations 2005 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by omitting " Security and Investigations Agents Act 2002 ." from the definition of Act and substituting " Security and Investigations Agents Act 2002 ;";
(b) by inserting the following definitions after the definition of Act :
temporary licence means a licence issued under the Act that the Director has issued on a temporary basis;
training provider licence means a licence issued by the Director under the Act that authorises the holder to provide training in respect of activities undertaken under the Act.

5.    Schedule 1 amended (Infringement Offences and Penalties)

Schedule 1 to the Principal Regulations is amended by omitting items 1 and 2 and substituting the following items:

6.    Schedule 2 amended (Fees)

Schedule 2 to the Principal Regulations is amended as follows:
(a) by inserting after paragraph (b) in item 1 the following paragraphs:
 

(c) for training provider licence

(b) by omitting "Commissioner" from column 2 of item 2 and substituting "Director";
(c) by omitting "Commissioner" from column 2 of item 5 and substituting "Director";
(d) by inserting after item 6 the following item:

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Security and Investigations Agents Regulations 2005 , consequent on the enactment of the Security and Investigations Agents Amendment Act 2010 , by –
(a) replacing references to the Commissioner for Corporate Affairs with references to the Director of Consumer Affairs and Fair Trading; and
(b) updating references to certain provisions of the Security and Investigations Agents Act 2002 ; and
(c) prescribing fees payable in certain circumstances.
