Poisons Amendment Regulations (No. 2) 2011

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment Regulations (No. 2) 2011 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Poisons Regulations 2008 are referred to as the Principal Regulations.

4.    Regulation 93A inserted

After regulation 93 of the Principal Regulations , the following regulation is inserted in Part 6:

93A.   Establishment of, and access to, database

Notwithstanding any other law, the Secretary may –
(a) use the information contained in any return provided in accordance with regulation 93 to establish a database; and
(b) authorise a person or class of persons to access information contained in the database if satisfied that such access would assist in achieving or implementing the purposes of the Act.

These regulations amend the Poisons Regulations 2008 to allow the Secretary to establish a database and to authorise access to information in that database.
