Inland Fisheries (Seasons and Waters) Amendment Order 2011
I make the following order under section 197 of the Inland Fisheries Act 1995 .

This order may be cited as the Inland Fisheries (Seasons and Waters) Amendment Order 2011 .
This order takes effect on the day on which its making is notified in the Gazette.
In this order, the Inland Fisheries (Seasons and Waters) Order 1996 is referred to as the Principal Order.
4. Clause 3 amended (Interpretation)
Clause 3(1) of the Principal Order is amended by omitting " Inland Fisheries (Recreational Fishing) Regulations 1999 " from the definition of Canal Bay and substituting " Inland Fisheries (Recreational Fishing) Regulations 2009 ".
5. Clause 4 amended (Taking of acclimatised fish)
Clause 4 of the Principal Order is amended as follows:(a) by omitting from subclause (1)(b)(v) "from Lake Rowallan upstream to an imaginary straight line drawn between 2 white posts on opposite shores of the river located approximately at grid reference E434734 N5379851 and grid reference E434811 N5379869" and substituting "above Lake Rowallan";(b) by omitting from subclause (1)(b)(vi) "River Leven from an imaginary straight line drawn between 2 white posts on opposite shores of the river located approximately at grid reference point E416578 N5423533 and grid reference point E416507 N5423648 upstream to where the bridge on Loongana Road crosses that river" and substituting "River Leven, upstream of the bridge on Loongana Road";(c) by omitting from subclause (1)(b)(vii) "Upper Mersey Lakes (within the Central Plateau Conservation Area and the Walls of Jerusalem National Park)" and substituting "Upper Mersey Lakes Rainbow Fishery";(d) by omitting paragraphs (c) , (d) and (e) from subclause (1) ;(e) by inserting the following subparagraph after subparagraph (iii) in subclause (1)(f) :(iiia) Huntsman Lake; and(f) by omitting subparagraph (vii) from subclause (1)(f) ;(g) by inserting the following paragraphs after paragraph (ca) in subclause (2) :(cb) at Brushy Lagoon from one hour before sunrise to one hour after sunset; and(cc) at Craigbourne Dam from one hour before sunrise to one hour after sunset; and(h) by omitting paragraph (d) from subclause (2) .
6. Clause 5 amended (Taking indigenous fish)
Clause 5(d) of the Principal Order is amended by omitting " Inland Fisheries (Recreational Fishing) Regulations 1999 (S.R. 1999, No. 157) " and substituting " Inland Fisheries (Recreational Fishing) Regulations 2009 ".
7. Clause 7 amended (Taking fish in certain waters)
Clause 7 of the Principal Order is amended by omitting subclause (2) .
8. Clause 8 amended (Prohibition on taking fish)
Clause 8 of the Principal Order is amended as follows:(a) by omitting paragraph (d) ;(b) by omitting paragraph (g) ;(c) by omitting paragraph (j) ;(d) by omitting paragraphs (p) and (pa) ;(e) by omitting paragraph (t) ;(f) by omitting from paragraph (v) " paragraphs (a) , (b) , (c) , (e) , (g) , (h) , (i) , (j) , (k) and (n) " and substituting " paragraphs (a) , (c) , (e) and (i) ".

This order amends the Inland Fisheries (Seasons and Waters) Order 1996 by –(a) updating certain provisions relating to the management of inland fisheries; and(b) effecting minor statute law revision.
