Vehicle and Traffic (Vehicle Operations) (Exemption) Notice 2011

The Transport Commission makes the following notice under regulation 45 of the Vehicle and Traffic (Vehicle Operations) Regulations 2001 .

1.   Short title

This notice may be cited as the Vehicle and Traffic (Vehicle Operations) (Exemption) Notice 2011 .

2.   Commencement

This notice takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

(1)  In this notice –
exempt route means the section of Mud Walls Secondary Road between the following junctions:
(a) the junction of Mud Walls Secondary Road and Tea Tree Secondary Road;
(b) the junction of Mud Walls Secondary Road and the Midland Highway.
(2)  The Acts Interpretation Act 1931 applies to the interpretation of this notice as if it were regulations within the meaning of that Act.

4.   Exemption

(1)  A vehicle or combination that exceeds 25 tonnes gross mass is exempt from regulation 64 of the Vehicle and Traffic (Vehicle Operations) Regulations 2001 in respect of the exempt route, if access to the exempt route, or to a road leading from the exempt route, is necessary for the vehicle or combination to –
(a) be garaged at an address within the municipal area of Southern Midlands; or
(b) pick up or drop off part or all of a load at a place within that municipal area; or
(c) be garaged at an address on Fingerpost Main Road between the following junctions:
(i) the junction of Fingerpost Main Road and the Tasman Highway;
(ii) the junction of Fingerpost Main Road and Colebrook Main Road; or
(d) be garaged at an address on Colebrook Main Road between the following junctions:
(i) the junction of Colebrook Main Road and Victoria Street;
(ii) the junction of Colebrook Main Road and Tea Tree Secondary Road; or
(e) pick up or drop off part or all of a load at a place between –
(i) the junctions referred to in paragraph (c) ; or
(ii) the junctions referred to in paragraph (d) .
(2)  The exemption –
(a) applies to the exempt route; and
(b) applies at all times of the day; and
(c) remains in force for the period of 3 years commencing on the date on which this notice takes effect.

5.   Legislation revoked

The legislation specified in Schedule 1 is revoked.

EXPLANATORY NOTE

(This note is not part of the notice)

This notice, made under the Vehicle and Traffic (Vehicle Operations) Regulations 2001  –
(a) exempts, for 3 years and for specified purposes, certain vehicles and combinations from the load limit applying to Mud Walls Secondary Road between Tea Tree Secondary Road and the Midland Highway; and
(b) revokes certain previous exemption notices made under those regulations that have expired.
