Road Amendment Rules (No. 3) 2010
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following rules under section 31A of the Traffic Act 1925 .

These rules may be cited as the Road Amendment Rules (No. 3) 2010 .
These rules take effect on 1 December 2010.
In these rules, the Road Rules 2009 are referred to as the Principal Rules.
4. Rule 266 amended (Wearing of seatbelts by passengers under 16 years old)
Rule 266 of the Principal Rules is amended as follows:(a) by omitting from subrule (4) "4 years old" and substituting "7 years old";(b) by inserting the following subrule after subrule (5) :(5A) If the exemption set out in subrule (5) applies to a driver in relation to a passenger who is 1 year old or older, but less than 7 years old, and who is not exempt from wearing a seatbelt under rule 267 , the passenger must wear an approved seatbelt that is properly adjusted and fastened to the best extent that is possible given the height and weight of the passenger.
5. Rule 299 amended (Television receivers and visual display units in motor vehicles)
Rule 299(2)(aa) of the Principal Rules is amended by omitting "disply" and substituting "display".
6. Rule 372 amended (Transitional rule: wearing of seatbelts by children less than 7 years old)
Rule 372(2) of the Principal Rules is amended by omitting "Until 30 November 2010, a passenger" and substituting "A passenger".
7. Rule 379 amended (Exemption for transport inspector)
Rule 379(2)(h) of the Principal Rules is amended by omitting "excep" and substituting "except".
8. Schedule 6 amended (Jurisdictional qualifications)
Schedule 6 to the Principal Rules is amended by omitting clause 3 from Part 3 and substituting the following clause:3. Rule 266(7): Approved child restraint, approved booster seat, approved child safety harnessFor rule 266(7) , a child restraint, booster seat or child safety harness is approved for the Road Rules if it complies with Australian/New Zealand Standard AS/NZS 1754, is marked in accordance with that Standard and has no visible defect.

EXPLANATORY NOTE
(This note is not part of the rule)
These rules amend the Road Rules 2009 by (a) amending the age, from 4 to 7 years old, at which a passenger is not required to use a child restraint; and(b) requiring a passenger who is less than 7 years of age to wear a seatbelt in certain circumstances where the passenger is exempt from using a child restraint; and(c) amending the approval requirements for certain child restraints; and(d) making other miscellaneous amendments.
