Rail Safety (Fees) Notice 2010

I make the following notice under section 25(1) of the Rail Safety Act 2009 .

1.   Short title

This notice may be cited as the Rail Safety (Fees) Notice 2010 .

2.   Commencement

This notice takes effect on the day on which section 25(1) of the Rail Safety Act 2009 commences.

3.   Interpretation

In this notice –

Act means the Rail Safety Act 2009 ;

heritage or not-for-profit organisation means a person or body carrying on rail operations –

(a) for the purposes of displaying Tasmanian heritage; or

(b) otherwise than for the principal purpose of making a profit.

4.   Fees

(1)  For the purposes of section 25(1)(a) of the Act, the fee for an application under section 18 of the Act is 221 fee units.

(2)  For the purposes of section 25(1)(b) of the Act, the annual registration fee for a private siding under section 16 of the Act is 37 fee units.

(3)  For the purposes of section 25(1)(c) of the Act, the annual accreditation fee for the purposes of section 26 of the Act is –

(a) 110 fee units if the accredited person is a heritage or not-for-profit organisation; or

(b) 184 fee units in any other case.

(4)  For the purposes of section 25(1)(d) of the Act, the relevant application fee for the purposes of section 33 of the Act is –

(a) 110 fee units if the accredited person is a heritage or not-for-profit organisation; or

(b) 184 fee units in any other case.

(5)  For the purposes of section 25(1)(e) of the Act, the fee for the late payment of –

(a) the fee determined under subclause (1) ; or

(b) the fee determined under subclause (3)  –

is, for each month, or part of a month, by which the fee determined under subclause (1) or (3) is paid late, 5% of the amount of the fee determined under subclause (1) or (3) respectively.
