Environmental Management and Pollution Control (Environmental Infringement Notices) Amendment Regulations (No. 2) 2010
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Environmental Management and Pollution Control Act 1994 .

These regulations may be cited as the Environmental Management and Pollution Control (Environmental Infringement Notices) Amendment Regulations (No. 2) 2010 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Environmental Management and Pollution Control (Environmental Infringement Notices) Regulations 2006 are referred to as the Principal Regulations.
4. Schedule 2 amended (Prescribed offences)
Schedule 2 to the Principal Regulations is amended as follows:(a) by omitting paragraph (e) from item 1 in Division 2 of Part 1 and substituting the following:
(e) residential premises of noise which is unreasonable having regard to –

(i) its volume, intensity or duration; and
(ii) the time, place and other circumstances in which it is emitted; and
(iii) whether it is, or is likely to be, audible in a habitable room of any other residential premises

(c) by inserting the following item after item 4 in Part 2 :5. Environmental Management and Pollution Control (Underground Petroleum Storage Systems) Regulations 2010

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations amend the Environmental Management and Pollution Control (Environmental Infringement Notices) Regulations 2006 by –(a) prescribing offences under the Environmental Management and Pollution Control (Underground Petroleum Storage Systems) Regulations 2010 for which infringement notices may be issued and the penalties payable for those infringement notice offences; and(b) revising existing offences, and adding new offences, under the Environmental Management and Pollution Control (Miscellaneous Noise) Regulations 2004 for which infringement notices may be issued and the penalties payable for those infringement notice offences.
