Local Government (Meeting Procedures) Amendment Regulations 2010
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Local Government Act 1993 .

These regulations may be cited as the Local Government (Meeting Procedures) Amendment Regulations 2010 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Local Government (Meeting Procedures) Regulations 2005 are referred to as the Principal Regulations.
4. Regulation 3 amended (Interpretation)
Regulation 3 of the Principal Regulations is amended by omitting the definition of council workshop and substituting the following definition:council workshop means a workshop, seminar or gathering of persons for the purposes of the council, but does not include a meeting or a meeting of a special committee;
5. Regulation 9 amended (Public access to documents)
Regulation 9 of the Principal Regulations is amended as follows:(a) by omitting subregulation (3) and substituting the following subregulation:(3) Subject to the Right to Information Act 2009 , the general manager must withhold from the public all associated reports and documents which, in the opinion of the general manager, relate to any matter referred to in regulation 15(2) .(b) by omitting subregulation (6) and substituting the following subregulation:(6) Despite subregulation (3) , but subject to the Right to Information Act 2009 , the general manager may authorise the release to the public of an associated report or document that he or she is otherwise required under that subregulation to withhold, if (a) the council or a council committee has authorised its release to the public under regulation 15(9) ; or(b) the council or a council committee has discussed, at a meeting that was not closed to the public under regulation 15 , the matter to which the associated report or document relates and has, after considering privacy and confidentiality issues, authorised its release to the public.
6. Regulation 15 amended (Closed meetings)
Regulation 15(9) of the Principal Regulations is amended by omitting "Any" and substituting "Subject to the Right to Information Act 2009 , any".
7. Regulation 16 amended (Motions)
Regulation 16 of the Principal Regulations is amended by omitting subregulation (1) and substituting the following subregulation:(1) The chairperson of a meeting may require a councillor intending to move a motion during the meeting to provide a written copy of the motion.
8. Regulation 30 amended (Questions on notice)
Regulation 30(1) of the Principal Regulations is amended by inserting "at least" after "councillor,".
9. Regulation 31 amended (Public question time)
Regulation 31(1) of the Principal Regulations is amended by inserting "at least" after "manager".
10. Regulation 34 amended (Minutes of closed meeting)
Regulation 34 of the Principal Regulations is amended as follows:(a) by inserting in subregulation (1)(b) "in the minutes of the open meeting" after "record";(b) by omitting subregulation (2) and substituting the following subregulation:(2) The general manager is to record in the minutes of a closed meeting any occurrence, of a kind listed in regulation 32(1) , that relates to the closed meeting.(c) by omitting subregulation (5) .

These regulations amend the Local Government (Meeting Procedures) Regulations 2005 to clarify the meaning of "council workshop" and to make provision in relation to the closure of meetings, the release of information, the period in which certain notices must be given, and the moving of motions during meetings.
