Environmental Management and Pollution Control Order 2010

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 11 of the Environmental Management and Pollution Control Act 1994 .

1.   Short title

This order may be cited as the Environmental Management and Pollution Control Order 2010 .

2.   Commencement

This order takes effect on 12 April 2010.

3.   Principal Act

In this order, the Environmental Management and Pollution Control Act 1994 is referred to as the Principal Act.

4.    Schedule 2 amended (Level 2 Activities)

Clause 3 of Schedule 2 to the Principal Act is amended by omitting paragraph (c) and substituting the following paragraph:
(c) Waste Transport Business: the transport, whether or not for fee or reward, of any controlled waste to Tasmania from another State or a Territory or from Tasmania to another State or a Territory.

EXPLANATORY NOTE

(This note is not part of the order)

This order amends Schedule 2 to the Environmental Management and Pollution Control Act 1994 by updating Waste Transport Business in Clause 3 of that Schedule, consequential on the commencement of Part 3 of the Environmental Management and Pollution Control (Controlled Waste Tracking) Regulations 2010 .
