Radiation Protection Amendment Regulations (No. 2) 2009
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Radiation Protection Act 2005 .

These regulations may be cited as the Radiation Protection Amendment Regulations (No. 2) 2009 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Radiation Protection Regulations 2006 are referred to as the Principal Regulations.
4. Regulation 42 amended (Exemptions for radiation sources used in educational institutions)
Regulation 42 of the Principal Regulations is amended as follows:(a) by omitting subregulation (1) and substituting the following subregulation:(1) In this regulation educational institution means (a) a school within the meaning of the Education Act 1994 that provides secondary education; or(b) the Tasmanian Academy established by the Education and Training (Tasmanian Academy) Act 2008 ; or(c) the Tasmanian Polytechnic established by the Education and Training (Tasmanian Polytechnic) Act 2008 ;Safety Guide means the document entitled "Safety Guide for the Use of Radiation in Schools Part 1: Ionizing Radiation (2009)" published by the CEO of ARPANSA, as amended or substituted from time to time.(b) by omitting from subregulation (2) "a school" and substituting "an educational institution";(c) by omitting from subregulation (3)(a) "Schools Code;" and substituting "Safety Guide;";(d) by omitting from subregulation (4) "a school" and substituting "an educational institution";(e) by omitting from subregulation (5) "Schools Code." and substituting "Safety Guide.".

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations amend the Radiation Protection Regulations 2006 by revising a provision that exempts radiation sources in schools from certain licensing and registration requirements of the Radiation Protection Act 2005 . More specifically, they (a) extend the application of that exemption to the Tasmanian Academy and the Tasmanian Polytechnic; and(b) omit an obsolete reference to TAFE Tasmania; and(c) replace a reference to a superseded code of practice.
