Building Amendment Regulations (No. 2) 2009
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under section 230 of the Building Act 2000 .

These regulations may be cited as the Building Amendment Regulations (No. 2) 2009 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Building Regulations 2004 are referred to as the Principal Regulations.
4. Regulation 43 amended (Interpretation)
Regulation 43 of the Principal Regulations is amended as follows:(a) by inserting the following definition before the definition of prescribed essential safety and health feature :educational institution means (a) a school within the meaning of the Education Act 1994 ; or(b) a campus of the Tasmanian Academy established by the Education and Training (Tasmanian Academy) Act 2008 ; or(c) a campus of the Tasmanian Polytechnic established by the Education and Training (Tasmanian Polytechnic) Act 2008 ;(b) by omitting subparagraph (iii) from paragraph (c) of the definition of prescribed essential safety and health feature and substituting the following subparagraph:(iii) a thermostatic mixing valve or tempering valve installed in a hospital, nursing home, early childhood centre, educational institution or similar facility for young, aged, sick or disabled persons; and
Displayed and numbered in accordance with the Rules Publication Act 1953.

These regulations amend the Building Regulations 2004 consequent on the enactment of the Education and Training (Miscellaneous and Consequential Amendments) Act 2008 , the Education and Training (Tasmanian Academy) Act 2008 and the Education and Training (Tasmanian Polytechnic) Act 2008 .
