Police Offences Amendment Regulations 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Police Offences Act 1935 .

1.   Short title

These regulations may be cited as the Police Offences Amendment Regulations 2009 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Police Offences Regulations 2007 are referred to as the Principal Regulations.

4.    Regulation 4 amended (Public places to which section 25 of Act applies)

Regulation 4 of the Principal Regulations is amended as follows:
(a) by omitting paragraph (d) from subregulation (2) ;
(b) by omitting from subregulation (3) " (d) ,";
(c) by inserting the following subregulation after subregulation (4) :
(5)  For the purposes of section 25 of the Act, the area of Crown land specified in Part 4 of Schedule 1 and known as Franklin Square is prescribed as a public place.

These regulations amend the Police Offences Regulations 2007 so as to make it an offence to consume liquor, or be in possession an opened or unsealed container of liquor, in Franklin Square, Hobart at any time.
