Food Amendment Regulations 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Food Act 2003 .

1.   Short title

These regulations may be cited as the Food Amendment Regulations 2009 .

2.   Commencement

These regulations take effect 7 days after the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Food Regulations 2003 are referred to as the Principal Regulations.

4.    Regulation 5A inserted

After regulation 5 of the Principal Regulations , the following regulation is inserted:

5A.   Application fee for approval of food safety auditors

For section 83A(3)(b) of the Act, the prescribed fee is 116 fee units.

5.    Schedule 1 amended (Infringement Notice Offences)

Schedule 1 to the Principal Regulations is amended as follows:
(a) by omitting item 27 and substituting the following:

These regulations are administered in the Department of Health and Human Services.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Food Regulations 2003 by prescribing –
(a) the fee payable on the making of an application for approval as a food safety auditor under section 83A(3)(b) of the Food Act 2003 ; and
(b) further offences under that Act for which infringement notices may be issued and the penalties payable for those infringement notice offences.
