Fluoridation (Interim) Amendment Regulations 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council and on the recommendation of the Fluoridation Committee, make the following regulations under the Fluoridation Act 1968 .

1.   Short title

These regulations may be cited as the Fluoridation (Interim) Amendment Regulations 2009 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Fluoridation (Interim) Regulations 2009 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended by inserting after the definition of Act the following definition:
fluoride concentration means the level of fluoride residual in water intended for human consumption;

5.    Regulation 3A inserted

After regulation 3 of the Principal Regulations , the following regulation is inserted:

3A.   Prescribed fluoride concentration range

For the purposes of section 8(2)(b) of the Act, the prescribed fluoride concentration range is between 0.8 milligrams per litre and 1.2 milligrams per litre.

6.    Regulation 5 amended (Analyses and tests)

Regulation 5(6) of the Principal Regulations is amended by omitting "excess fluoride" and substituting "a fluoride concentration in excess of 1.5 milligrams per litre".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Fluoridation (Interim) Regulations 2009 by –
(a) prescribing the acceptable fluoride concentration range for a public water supply; and
(b) prescribing the notifiable fluoride concentration level for a water authority.
