Conveyancing Amendment Regulations 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Conveyancing Act 2004 .

1.   Short title

These regulations may be cited as the Conveyancing Amendment Regulations 2009 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Conveyancing Regulations 2005 are referred to as the Principal Regulations.

4.    Regulation 5 amended (Qualifications and experience)

Regulation 5 of the Principal Regulations is amended by omitting paragraph (b) and substituting the following paragraph:
(b) 2 years' full-time practical experience, or the equivalent practical experience, in conveyancing work gained in a licensed conveyancer's office, law practice, within the meaning of the Legal Profession Act 2007 , or any business or government department or government agency where conveyancing work is regularly undertaken, which experience –
(i) must be gained within the 3 years immediately preceding the day on which the application for a licence under section 6 of the Act is lodged with the Director; and
(ii) may be gained before, during or after obtaining a qualification referred to in paragraph (a) ; and
(iii) may be gained wholly or partly in Tasmania or in any other State or a Territory.

These regulations amend the Conveyancing Regulations 2005 so as to revise the eligibility requirements for a conveyancing licence to ensure that licensees have current practical conveyancing experience.
