Sale of Hazardous Goods (Children's Portable Folding Cots) Order 2009

The Products Safety Committee makes the following order under section 8 of the Sale of Hazardous Goods Act 1977 .

1.   Short title

This order may be cited as the Sale of Hazardous Goods (Children's Portable Folding Cots) Order 2009 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

In this order –
children's portable folding cot means an enclosure intended for childrenwhich can be used for sleeping and which can be folded when not in use and includes playpens with a floor but not those without a floor;
Folding Cots Safety Standard means the Australian and New Zealand Standard AS/NZS 2195:1999 entitled "Folding cots – Safety requirements" published by Standards Australia on 15 November 1999 as in force on the day this order takes effect.

4.   Restriction on sale of children's portable folding cots

(1)  A person must not sell a children's portable folding cot unless it complies with the Folding Cots Safety Standard, as taken to be modified for the purposes of this clause.
(2)  For the purposes of this clause, the Folding Cots Safety Standard is taken to be modified as specified in Schedule 1 to this order.

(c) Either a warning to use a mattress of specified dimensions or a warning to use the mattress supplied by the manufacturer.

  

(d) A warning not to add an extra mattress as this may cause suffocation.
