Electricity Supply Industry Amendment Regulations 2009
I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Electricity Supply Industry Act 1995 .

PART 1 - Preliminary
These regulations may be cited as the Electricity Supply Industry Amendment Regulations 2009 .
(1) Except as provided in this regulation, these regulations take effect on the day on which their making is notified in the Gazette.(2) Part 3 takes effect on the seventh day after the day on which the making of these regulations is notified in the Gazette.
PART 2 - Electricity Supply Industry Regulations 2008 Amended
In this Part, the Electricity Supply Industry Regulations 2008 are referred to as the Principal Regulations.
4. Regulation 3 amended (Interpretation)
Regulation 3 of the Principal Regulations is amended as follows:(a) by inserting the following definition after the definition of Act :electricity generating plant of historic significance means an electricity generating plant specified in Schedule 2 ;(b) by omitting the definition of stand-alone generator .
5. Regulation 4 amended (Circumstances in which licence not required)
Regulation 4 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (1)(a) "stand-alone";(b) by omitting paragraph (b) from subregulation (1) and substituting the following paragraph:(b) the electricity is (i) generated by a generator that is not normally connected to a power system or has a primary function other than the generation of electricity for sale; and(ii) not sold.(c) by inserting the following paragraphs after paragraph (a) in subregulation (3) :(ab) a person who sells electricity only to another person who holds a licence authorising the retailing of electricity; or(ac) the owner of an electricity generating plant of historic significance in relation to the sale of electricity generated by that plant; or
6. Schedule 2 inserted
After Schedule 1 to the Principal Regulations , the following Schedule is inserted:SCHEDULE 2 - Electricity Generating Plants of Historic Significance
1.
The electricity generating plant known as the Lake Margaret Power Station situated on the Yolande River
2.
The electricity generating plant known as the Lower Lake Margaret Power Station situated on the Yolande River
PART 3 - Electricity Supply Industry Regulations 2008 Further Amended
In this Part, the Electricity Supply Industry Regulations 2008 are referred to as the Principal Regulations.
8. Regulation 9 inserted
After regulation 8 of the Principal Regulations , the following regulation is inserted:The fee payable on application under section 18 of the Act for a licence to carry on operations in the electricity supply industry is 330 fee units.

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations amend the Electricity Supply Industry Regulations 2008 to (a) prescribe the fee payable for a licence under Division 1 of Part 3 of the Electricity Supply Industry Act 1995 ; and(b) provide that a licence is not required for (i) the retailing of electricity to another retailer licensed under that Act; or(ii) the retailing of electricity generated by certain specified power stations of historic significance; or(iii) the generation of electricity by all generators with a capacity of 5 megawatts or less.
