Poisons List Amendment Order (No. 3) 2009
I make the following order under section 15(1) of the Poisons Act 1971 .

This order may be cited as the Poisons List Amendment Order (No. 3) 2009 .
This order takes effect on the day on which its making is notified in the Gazette.
In this order, the Poisons List Order 2001 is referred to as the Principal Order.
4. Schedule 2 amended (Medicinal Poisons)
Schedule 2 to the Principal Order is amended as follows:(a) by inserting after item 2057 the following:
2057M.
Guaiphenesin in a modified release dosage form of 1200mg or less of guaiphenesin, with a recommended daily dose of 2400mg or less when not labelled for the treatment of children under 12 years of age.
(b) by omitting item 2062 and substituting the following:
2062.
Hydroquinone (excluding monobenzone and other alkyl ethers of hydroquinone included in Schedule 4 ) in preparations for human external therapeutic or cosmetic use containing 2% or less of hydroquinone except in hair preparations containing 0.3% or less of hydroquinone.
5. Schedule 4 amended (Restricted Substances)
Schedule 4 to the Principal Order is amended as follows:(a) by inserting after item 40046 the following:

Alpha1-proteinase inhibitor (human).

6. Schedule 5 amended (Domestic Poisons)
Schedule 5 to the Principal Order is amended as follows:(a) by inserting after item 5105 the following:

Diethylene glycol (excluding its salts and derivatives) in preparations containing not less than 10mg/kg of denatonium benzoate as a bittering agent, except –
(a) in paints or paint tinters; or
(b) in toothpastes or mouthwashes containing more than 0.25% of diethylene glycol; or
(c) in other preparations containing 2.5% or less of diethylene glycol.
(b) by omitting item 5126 and substituting the following:
5126.
Ethylene glycol (excluding its salts and derivatives) in preparations containing not less than 10mg/kg of denatonium benzoate as a bittering agent, except –

(a) when included in Schedule 5 ; or
(b) in paints or paint tinters; or
(c) in toothpastes or mouthwashes containing more than 0.25% of diethylene glycol; or
(d) in other preparations containing 2.5% or less of diethylene glycol.
(b) by omitting item 6175 and substituting the following:

Ethylene glycol (excluding its salts and derivatives) except –
(a) when included in Schedule 5 ; or

8. Schedule 7 amended (Dangerous Poisons)
Schedule 7 to the Principal Order is amended by inserting after item 7527 in Part 2 the following item:

Ethylene glycol for use in toothpastes or mouthwashes except in preparations containing 0.25% or less of ethylene glycol.
