Administrative Arrangements Order (No. 2) Amendment Order 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 4(1) of the Administrative Arrangements Act 1990 .

1.   Short title

This order may be cited as the Administrative Arrangements Order (No. 2) Amendment Order 2009 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were by-laws.

4.   Principal Order

In this order, the Administrative Arrangements Order (No. 2) 2009 is referred to as the Principal Order.

5.    Schedule 1 amended (Administration of Departments and Enactments)

Schedule 1 to the Principal Order is amended as follows:
(a) by inserting in Part 2 after

Personal Information Protection Act 2004

the following item:

Poisons Act 1971

in so far as it relates to the Poppy Advisory and Control Board (otherwise see the Department of Health and Human Services under the Minister for Health)

(b) by omitting from Part 8

Poisons Act 1971

and substituting the following item:

Poisons Act 1971

except in so far as it relates to the Poppy Advisory and Control Board (see the Department of Justice under the Minister for Justice)

Displayed and numbered in accordance with the Rules Publication Act 1953.

This order is administered in the Department of Premier and Cabinet.

EXPLANATORY NOTE

This order amends the Administrative Arrangements Order (No. 2) 2009 by transferring the administration of the Poisons Act 1971 in so far as it relates to the Poppy Advisory and Control Board from the Minister for Health to the Minister for Justice.
