Government Prices Oversight (Metro Bus Fares) Order 2009

I make the following order under section 36 of the Government Prices Oversight Act 1995 .

1.   Short title

This order may be cited as the Government Prices Oversight (Metro Bus Fares) Order 2009 .

2.   Commencement

This order takes effect 61 days after the day on which its making is notified in the Gazette.

3.   Interpretation

(1)  In this order –
Agreement means –
(a) the agreement, as amended from time to time, in respect of the provision of scheduled route services made on 1 January 2009 between the Transport Commission and Metro Tasmania Pty. Ltd., signed on behalf of the Commission by the Commissioner for Transport, Mr David Peters, and on behalf of Metro Tasmania Pty. Ltd. by the Chairperson of the Metro Board; or
(b) an agreement, as amended from time to time, in respect of scheduled route services between the Transport Commission and Metro Tasmania Pty. Ltd. that replaces or supersedes the agreement referred to in paragraph (a) ;
Commissioner for Transport means the Commissioner for Transport appointed under the Transport Act 1981 ;
fifth year means the period of 12 months commencing on the fourth anniversary of the day on which this order takes effect;
first year means the period of 12 months commencing on the day on which this order takes effect;
fourth year means the period of 12 months commencing on the third anniversary of the day on which this order takes effect;
full adult fares means the fares to be charged to full-fare-paying adult passengers for single-trip tickets and multi-trip tickets;
Metro means Metro Tasmania Pty. Ltd.;
Metro Greencard means an electronic card issued by Metro that stores credit for travel on scheduled route services;
scheduled route services means the regular passenger transport services specified in the Agreement as comprising the Metro Service Activity that Metro is contracted to deliver;
second year means the period of 12 months commencing on the first anniversary of the day on which this order takes effect;
third year means the period of 12 months commencing on the second anniversary of the day on which this order takes effect;
Transport Commission means the Transport Commission incorporated under the Transport Act 1981 .
(2)  The Acts Interpretation Act 1931 applies to the interpretation of this order as if the order were regulations.

4.   Scope of order

This order specifies the maximum full adult fares that Metro may charge for travel on scheduled route services.

5.   Maximum full adult fare for single trip

(1)  A full adult fare charged by Metro at any time during the first year must not exceed, for a single trip, the amount specified in column 1 of Schedule 1 .
(2)  A full adult fare charged by Metro at any time during the second year must not exceed, for a single trip, the amount specified in column 2 of Schedule 1 .
(3)  A full adult fare charged by Metro at any time during the third year must not exceed, for a single trip, the amount specified in column 3 of Schedule 1 .
(4)  A full adult fare charged by Metro at any time during the fourth year must not exceed, for a single trip, the amount specified in column 4 of Schedule 1 .
(5)  A full adult fare charged by Metro at any time during the fifth year must not exceed, for a single trip, the amount specified in column 5 of Schedule 1 .

6.   Maximum price payable for certain credit on Metro Greencard

The price payable to Metro in respect of credit purchased for a full-fare-paying adult passenger's Metro Greencard must not exceed 80% of the amount credited to that card if the amount purchased –
(a) is at least $20 in a single transaction; and
(b) is required to be used within 31 days of first use.

7.   Expiry

This order ceases to have effect at the end of the period of 5 years commencing on the day on which this order takes effect.

8.   Legislation revoked

The legislation specified in Schedule 2 is revoked.

EXPLANATORY NOTE

(This note is not part of the order)

This order –
(a) specifies the maximum full adult fares that Metro Tasmania Pty. Ltd. may charge on scheduled route services during the period of 5 years following the day on which the order takes effect; and
(b) revokes the Government Prices Oversight (Metro Bus Fares) Order 2006 .
