Plumbing Amendment Regulations 2009
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Building Act 2000 .

These regulations may be cited as the Plumbing Amendment Regulations 2009 .
These regulations take effect on 1 July 2009.
In these regulations, the Plumbing Regulations 2004 are referred to as the Principal Regulations.
4. Regulation 3 amended (Interpretation)
Regulation 3(1) of the Principal Regulations is amended as follows:(a) by inserting the following definition after the definition of registered break tank :regulated entity has the same meaning as in the Water and Sewerage Industry Act 2008 ;(b) by inserting the following definition after the definition of service pipe :serviced land, in relation to a regulated entity, means land that is described in as land that the entity will permit to be connected to the entity's water infrastructure, or sewerage infrastructure, within the meaning of that Act;(a) a policy under section 56U(4) of the Water and Sewerage Industry Act 2008 ; or(b) a price and service plan submitted by the entity and approved under section 65 of the Water and Sewerage Industry Act 2008 (c) by omitting the definition of sewerage system ;(d) by omitting the definition of trade waste agreement .
5. Regulation 4 amended (Certain plumbing and plumbing work exempt)
Regulation 4 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (2)(a) "sewerage system" and substituting "sewerage installation";(b) by omitting from subregulation (4)(b) "relevant council" and substituting "relevant regulated entity or council".
6. Regulation 7 amended (Non-complying products and materials)
Regulation 7 of the Principal Regulations is amended by omitting "the permit authority" and substituting "the relevant regulated entity, or the permit authority, whichever is responsible for the system, after consulting, if it thinks fit, the relevant regulated entity,".
7. Regulation 8 rescinded
Regulation 8 of the Principal Regulations is rescinded.
8. Regulation 9 amended (Trade waste)
Regulation 9 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (1) "a sewerage system" and substituting "an approved disposal system (other than a sewerage system)";(b) by omitting from subregulation (2) "a sewerage system" and substituting "an approved disposal system";(c) by omitting subregulations (6) , (7) , (8) , (9) and (10) and substituting the following subregulations:(7) A person must not dilute trade waste to achieve compliance with any of the requirements, set out in a special plumbing permit issued under the Building Act 2000 , for the discharge of liquid trade waste into an approved disposal system (other than a sewerage system).Penalty: Fine not exceeding 20 penalty units, and an additional fine not exceeding 10 penalty units for each day during which the offence continues.(8) If an analysis of the characteristics of trade waste discharged into an approved disposal system (other than a sewerage system) is required, the analysis must be performed by a NATA registered laboratory or other laboratory approved by the general manager or permit authority.
9. Regulation 11 amended (Backflow prevention devices)
Regulation 11 of the Principal Regulations is amended as follows:(a) by omitting from paragraph (a) ", zone or property" and substituting "or zone";(b) by omitting from paragraph (b) ", zone or property" and substituting "or zone".
10. Regulation 13 amended (Sewerage inlets and flood levels)
Regulation 13 of the Principal Regulations is amended by omitting subregulation (1) and substituting the following subregulation:(1) A regulated entity may declare a drainage flood level for the purpose of protecting a sewerage system in respect of any of the entity's serviced land.
11. Regulation 17 amended (Granting of plumbing permits)
Regulation 17(1) of the Principal Regulations is amended as follows:(a) by omitting "matter are" and substituting "matters are";(b) by inserting the following paragraph after paragraph (c) :(ca) the applicant is to hold a certificate for certifiable work (plumbing) issued under section 56TC of the Water and Sewerage Industry Act 2008 , if the certificate is required under section 56TB of that Act to have been issued before the permit may be granted;(c) by omitting paragraphs (e) and (f) ;(d) by inserting in paragraph (g) "for a trade waste installation that is not connected to a sewerage system" after "plumbing permit";(e) by inserting in paragraph (h) "for a trade waste installation that is not connected to a sewerage system" after "plumbing permit";(f) by omitting from paragraph (i) "the sewerage system" and substituting "for a trade waste installation that is not connected to a sewerage system, the approved disposal system".
12. Regulation 20 amended (Variations to permit)
Regulation 20 of the Principal Regulations is amended by inserting after subregulation (3) the following subregulation:(3A) A permit authority must consult the relevant regulated entity about an application for a variation of a permit, if a certificate for certifiable work (plumbing) was required under section 56TB of the Water and Sewerage Industry Act 2008 to have been issued by the entity before the application for the permit may be granted.
13. Regulation 21 amended (Variations to special plumbing permit trade waste)
Regulation 21(1) of the Principal Regulations is amended by omitting "a sewer" and substituting "an approved disposal system, other than a sewerage system,".
14. Regulation 22 amended (Suspension of special plumbing permit)
Regulation 22(1) of the Principal Regulations is amended as follows:(a) by omitting from paragraph (d) "the sewerage system" and substituting "an approved disposal system, other than a sewerage system";(b) by omitting from paragraph (e) "sewerage system" and substituting "an approved disposal system, other than a sewerage system,";(c) by omitting subparagraph (ii) from paragraph (e) and substituting the following subparagraph:(ii) damage to the approved disposal system or to the apparatus treating the sewage; or
15. Regulation 27 amended (Conditions on permit for trade waste system or on-site waste water management system)
Regulation 27(1) of the Principal Regulations is amended by omitting "trade waste system" and substituting "trade waste system (other than such a system connected to a sewerage system)".
16. Regulation 28 amended (Conditions on permit for discharge of trade waste)
Regulation 28 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (1) "to a sewerage system" and substituting "to an approved disposal system, other than a sewerage system,";(b) by omitting from subregulation (1)(j) "the councils sewerage system" and substituting "an approved disposal system, other than a sewerage system";(c) by omitting subregulations (2) , (3) and (4) .
17. Regulation 32 amended (Condition on permit for connection to water supply system, sewerage installation or stormwater system)
Regulation 32 of the Principal Regulations is amended by omitting "sewerage system" and substituting "sewerage installation".
18. Regulation 40 amended (Connections to stormwater systems)
Regulation 40 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (1) "a sewerage system, stormwater system or water supply system," first occurring and substituting "stormwater system,";(b) by omitting from subregulation (1) "sewerage system, stormwater system or water supply system," second occurring and substituting "stormwater system,";(c) by omitting from subregulation (2) "sewerage system, stormwater system or water supply system" and substituting "stormwater system".
19. Regulation 41 amended (Disconnection of services)
Regulation 41 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (1) "sewerage system, stormwater system or water supply system" and substituting "stormwater system";(b) by omitting subregulation (2) and substituting the following subregulation:(2) If the general manager or permit authority determines that the relevant council's stormwater system is not sealed satisfactorily, the general manager may enter the land on which the disconnection took place and carry out any works necessary to correct the sealing of the stormwater system.
20. Regulation 50 amended (Maintenance and management of on-site waste water management systems)
Regulation 50(1) of the Principal Regulations is amended by inserting "management" after "water" in paragraph (a) of the definition of use, operate, maintain or manage .
21. Schedules 1 and 2 rescinded
Schedules 1 and 2 to the Principal Regulations are rescinded.
22. Schedule 3 amended (Act infringement notice offences)
Schedule 3 to the Principal Regulations is amended as follows:(a) by omitting item 16 ;(b) by omitting "a sewer" from column 3 of item 17 in the table and substituting "an approved disposal system, other than a sewerage system";(c) by omitting "a standard for acceptance of liquid trade waste" from column 3 of item 18 in the table and substituting "a requirement of a special plumbing permit";(d) by omitting "sewerage, stormwater system or water-supply system" from column 3 of item 28 in the table and substituting "stormwater system";(e) by omitting "sewer, stormwater or water supply system" from column 3 of item 30 in the table and substituting "stormwater system".
