Legal Profession Amendment Regulations 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Legal Profession Act 2007 .

1.   Short title

These regulations may be cited as the Legal Profession Amendment Regulations 2009 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Legal Profession Regulations 2008 are referred to as the Principal Regulations.

4.    Regulation 63 amended (Disclosure of costs to clients – form)

Regulation 63(1) of the Principal Regulations is amended by omitting " sections 291(1)(b)(i) , (ii) , (iii) , (g) , (i) and (l) of the Act" and substituting " sections 291(1)(b)(i) , (ii) and (iii) , (g) , (i) , (j) and (l) of the Act".

5.    Regulation 70 inserted

After regulation 69 of the Principal Regulations , the following regulation is inserted in Part 7:

70.   Law libraries

(1)  For the purposes of section 620(c) of the Act, a prescribed function of the Law Society is the management and funding of law libraries.
(2)  A local legal practitioner, other than a lawyer entitled to practise without a practising certificate by virtue of section 41 of the Act, is to pay to the Law Society an annual library levy of 460 fee units.
(3)  The annual library levy referred to in subregulation (2) is a prescribed levy for the purposes of section 49(1)(b) of the Act.

6.    Schedule 1 amended (Forms)

Schedule 1 to the Principal Regulations is amended by omitting Form 2 and substituting:

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Legal Profession Regulations 2008 by –
(a) clarifying the information that is to be disclosed in respect of costs; and
(b) empowering the Law Society to manage law libraries; and
(c) requiring certain legal practitioners to pay an annual library levy to the Law Society.
